Ball to Harvey Indenture
This indenture made the 16th day of June 1785 between Richard Ball of the County of Lancaster and Mary Ball his wife of the one part and Mungo Harvey of the same county of the other part. Whereas William Ball, late of the said County of Lancaster, deceased by his last will and testament devised unto his grandson, Williamson Ball, son of his son William Ball, deceased, all his lands in Westmoreland County, and to his issue and for want of such issue to his grandson Benjamin Ball and to his male issue and for want of such issue to his grandson the said Richard Ball and to his issue with sundry other remainders, and also devise that his daughter-in-law Margaret Ball should have the use of the said lands during her life, and whereas the said Williamson Ball and Benjamin Ball died without issue and the said Margaret Ball is also dead and whereupon the said lands descended to the said Richard Ball in tail, and whereas an act of General Assembly passed in October 1776 declaring tenants of lands or slaves in tail to hold the same in fee simple, whereby the said Richard Ball became seized of the said lands in fee simple and is now in actual possession thereof, containing by estimation 350 acres. This indenture witnesseth that Richard Ball and Mary Ball his wife in consideration of 1200 pounds current money has sold unto Mungo Harvey all those lands in Westmoreland County devised by William Ball as aforesaid. In witness whereof the said Richard Ball and Mary Ball his wife have here unto set their hands and seals the day and year first above written. Signed sealed and delivered in presence of.
