Will Transcript

In the name of God Amen, I Jas. W. Ball of the county of Lancaster being of perfect mind and memory (thanks be given unto God) to make and ordain this my last will and testament
Imprimis, I give unto my dearly beloved wife Ann Ball the use of the following negroes during her life, viz. Adam, planter Joe, Suller? and Nancy and their increase, to be disposed of at her death to either or amongst my children as she shall think proper.
Item ~ I give unto my dear wife during her widowhood, the use, of all my estate both real and person for the support of her, and our children, in such manner as she shall think proper
Item ~ It is my will and desire that at the death or marriage of my wife that my executors hereafter named shall all that part of my land that I purchased of Capt. Richd. Selden which lies on the east side of Bradleys swamp agreeable to a survey made by Henry Hinton, together with the water grist mill for the best price that they can get, and that the money arising from such sale together with my certificates shall be equally divided amongst my Daughters Mary Wallace, Ann, Judith Ephan? and Sarah Ball.
Item ~ At the Death or marriage of my wife I give unto my son Cyrus Ball the use of all the remainder of my lands I possess in the County of Lancaster during his life, and in case he should have heirs lawfully begotten that he shall or may dispose of the said land to either or amongst the said Heirs as he shall think proper, but in case that my said son should die without such heirs then my will is that the said lands equally Divided amongst my Daughters.
Item ~ At the Death or marriage of my wife I give unto my son Cyrus my twelve Mahogany chairs, clock, and walnut tables that stand in the dining room
Item ~ It is my will and desire that at the death or marriage of my wife that the remainder of my estate of all kinds whatsoever (my negro man Joshua excepted) shall be equally divided amongst all my Children
Item ~ It is my will and desire that my negro man Joshua shall be maintained and supported with good and sufficient cloathing and victuals? during her life out of my estate, and that he shall not be appraised or divided in my estate nor be subject to the orders or control of any person whatsoever except my wife
Item ~ It is my will and desire that my ___ hereafter named shall or may if they are good cause to do to, sell the land whereon I now life, together with the grist mill, and the money arising from such sale to be applied to the purchase of other lands in lieu of and for the same use as the said Plantation was intended.
Item ~ It is my will and desire that my wife and other Extrs shall be at liberty to deliver up to either of my children any part of my estate that they may have a right to, or a Division, provided such part shall not exceed their proportion
Item ~ It is my will and desire that my Extrs shall have power to sell or Dispose of such part of my estate as they shall think proper and to pay such debts as they shall think fit to pay out of such sale which appear to be lawfully due from either my late father __ Richd. Ball dec'd, or myself provided such debts are reasonable by Law.
And lastly I constitute and appoint my dearest and loving wife Ann Ball, Col. James Ball, __ John Fauntleroy and __ Spencer Ball Executrix and Executors of this my last will and testament.
In witness whereof I hereunto set my hand and seal this eighth day of Nov. one thousand seven hundred and ninety four.

Codicil to this my last will and Testament. Item it is my will and desire that my Exetr. shall make to Seduther? Moore, a lawful right and title or to such other person as may have a more legal right, to fifteen acres of land which my late father sold to Richd. Cundiff, and for which us deed was ever given which land the said Moore is now in possession of:
In witness whereof I hereunto set my hand and seal this 19th day of Nov. 1794.

A further Codicil to this my last will and Testament.
Item it is further my will and desire that my executors heretofore named shall have the same right and power that I have or might have in my lifetime to sell or otherwise Dispose of any part of my personal estate that they may think proper is to dispose of and to purchase such other property as they shall think more for the advantage of my family, provided such property is purchased be applied to the same purposes as the part for which it was sold or exchanged for would have been.

At a court held for Lancaster County on the 17th day of February 1795
This last Will and Codicils of James W. Ball dec'd were proved to be the hand writing of the said Decedent by the oaths of William Chowning and Sevre? Galle, and ordered to be recorded.
