Will Transcript

In the Name of God, Amen,
I Peter Moyer of the County of Wythe, and Commonwealth of Virginia, being of Sound mind and disposing memory, think proper to make my last will & Testament, in manner following, to wit,
I desire that after my decease my personal property may be sold, and my Just debts paid out of it, and the balance after payment of the Legacies herein after directed to be paid out of the same, to be divided equally amongst all my children.
Item. I give and bequeath to my two sons Peter and John the tract of Land I purchased of Petter Kettering containing about two Hundred acres; my son Peter to have the upper end of said Tract including the old improvement and the tract to be equally divided as to quantity without regard to quality. I also give and bequeath to my said two sons Peter and John, an other tract of Lane, adjoining the former and being the same I purchased of Nicholas Cline, containing upwards of one hundred and sixty acres, to be equally divided between my said sons Peter and John according to quality, without regard to quality - they paying such Legacies as herein after directed to be paid by them with Land I give and bequeath to my said sons Peter and John to be enjoyed by them for ever.
Item, I give and bequeath to my two sons Michael and Henry the tract of Land on which I at present reside Lying on the south fork of Reed Creek, being two surveys and containing in the whole about two hundred and Eighty acres to be equally divided between my said two sons Michael & Henry according to quantity, without regards to quality, and to be enjoyed by them forever, they paying such Legacies as are herein after directed to be paid by them,
I give and bequeath to my said son Michael a good saddle Horse out of my personal Estate.
Item, I give and bequeath to my six Daughters, namely, Molly, the wife of Martin Kegley, Barbara the wife of Martin Wyrick, Peggy, Catharine, Leah, and Sarah, one hundred & sixteen Dollars & four shillings each to be paid to them by my four sons Peter, John, Michael & Henry in the following manner to wit Two hundred Dollars to be paid by son Peter, Two hundred dollars to be paid by my son John Two hundred dollars, to be paid by my son Michael, and one hundred Dollars to be paid by my son Henry the whole to be paid within two years after my decease; except that part to be paid by my son Henry, which is not to be paid by him but until he attains the age of twenty one years should he not attain that age within two years after my decease, One half of the said sums to be paid my Daughters as aforesaid shall be paid to them in Cash the other half in good Property.
Item I give and bequeath to my four Daughters Peggy, Catherine, Leah and Sarah, two good cows and one feather Bed and furniture, to each of them, to be paid out of my personal Estate.
Item it is my will and desire that my four sons Peter, John, Michael & Henry shall give and furnish to my beloved wife Catharine a good decent and comfortable maintainance and support during her life.
Item, It has been my intention that my three sons Peter, John & Michael should pay to me during my life, the sum of One hundred Dollars, each are equally paid in consideration of my bequeathing to them the land before mentioned, now it is my will and desire, that should the aforesaid sum of one hundred dollars not be demanded of my said sons Peter, John & Michael, and paid by them, during my life, that the same shall be equally divided between all my children the said Peter, John & Michael retaining for themselves an equal share with the rest.
Lastly I constitute and appoint my friend Joseph Crockett Esquire Executor of this my last will and testament, hereby revoking all other or former Wills and Testaments by me heretofore made.
In testimony where I have hereunto set my hand and affixed my seal this ____ day of ___ in the year of our Lord one thousand eight hundred and fourteen (1814).

Signed, sealed, published and declared by the Testator as and for his last Will and Testament in our presence who have signed our names as Witnesses thereto in his presence and at his request.

At a Court of Monthly Session held for the County of Wythe At the Court house on Tuesday the eighth of April 1817.
This the last will and testament of Peter Moyer dec'd was produced in Court & being proved by the oaths of Christopher Brown & John Lundenberger two of the subscribing witnesses thereto the same is ordered to be recorded. And Joseph Crockett the Executor named in said Will having refused to take upon himself of the burthen of the Execution thereof & relinquishes all his right as Executor under the same; and Catherine Moyer Widow of the said Peter havnig also relinquished her right to the administraton of the said Estate of Peter Moyer dec'd; On the motion of Peter Moyer & Michael Moyer Letters of administration with the will annexed is granted them of said Estate, whereupon the entered into bond with Leonard Draw? Jr. & Palser Johnston their Securities in the penalty of two thousand Dollars conditioned as the Law directs & took the oath required by Law.
