Peter Hammon, one of the securities of Obadiah Hammon, administrates of John Hammon deced, having applied to be relieved from his security ship and a summons having issued to the county of Knox and having been returned executed on said Hammon - And he having failed to give counter security as required by law It is ordered that the said Peter Hammon be discharged from his liability and that the Sheriff of this county be directed to act as the administrater of the estate aforesaid in room of said Obadiah Hammon - And the said Sheriff be directed to call on said Hammon. for all papers in his possession relating to said estate.


State of Kentucky Knox County This indenture made this 16th day of June 1842 between JAMES HAMMOND SR. DORCAS HAMMOND, PETER HAMMOND, EMILY HAMMOND, and JOHN HAMMOND, heirs of PETER HAMMOND deceased of the one part and THOMAS HALES of the other part, all of the county of Knox and the state of Kentucky, except DORCAS who resides in Laurel County. Witnessath: That --- in consideration of the sum of seventy five dollars paid to the said PETER HAMMOND deceased in his life time, the receipt where of we hereby acknowledge have granted bargained and sold and by these presents do alien and convay unto the said THOMAS HALES his heirs or assing forever one certain tract on parcel of land known by the name of the "Crane's Nest" lying in the said county of Knox on Richland Creek and bounded as --- ---- ----. Beginning in a line made between HUGH HALES and ISAIAH HAMMOND at a white oak and black oak running from thence of the creek on both sides to the said PETER HAMMOND border by HENRY BANKS on the 18th day of April 1828, and is of record in the clerk's office of the Knox County court. To have and to hold the said tract or parcel of land unto him the said THOMAS HALES his heirs and assigns forever, free from claim of the heirs aforesaid and their heirs and from the claim of all other persons by through or under them. State of Kentucky Knox County I JAMES F. BALLINGER Clerk of the County Court of the county aforesaid do certify that this deed from JAMES HAMMOND and STACY his wife. PETER HAMMOND, JOHN HAMMOND, EMILY HAMMOND, DORCAS MCCARTY and WILLIAM MCCARTY --- on the 21st day of June 1842 produced to me in my office, and acknowledged by the said JAMES HAMMOND to be his act and deed; and the said STACY being by me examined privately and apart from her said husband declined that she did freely and voluntarily seal and deliver said writing and wished not to retract it, and acknowledged said might again shown and explained to be her act and deed and consented that the same might be recorded; and on the 5th day of December 1842 the said deed was previously recorded; and on the 5th day of December 1842 the said deed was proven by the oath of ISHAM HUBBARD and WESTLEY HALES the subscribing witnesses --- to be the act and deed of the said PETER HAMMOND, JOHN HAMMOND, EMILY HAMMOND, DORCAS MCCARTY and Wm MCCARTY; and the same has been duly admitted to record in my office. Knox County, KY Lawsuit, filed 9 March 1851:

THOMAS HALE and MARY HALE vs JAMES HAMMONDS and others, the heirs of PETER HAMMONDS, SR., deceased. The plaintiffs, THOMAS HALE and MARY HALE, his wife, state that on the -- day of --, the father of the said, MARY, PETER HAMMONDS, SR., departed this life intestate, siezed and possessed and the owner of a tract of land in Knox County, Ky., lying on the (right-hand Fork of Big -- print is missing for two sentences -- and leaving the following persons, the plaintiffs, his heirs and legal representatives to wit: JAMES HAMMONDS (the only living son he has), DORCAS MCCARTY and her husband, WILLIAM MCCARTY, JOHN HAMMONDS, EMILY HAMMONDS, WILLIAM SPEED HAMMONDS, MARY COLE and her husband, JAMES COLE, ESTHER HAMMONDS, these the children of PETER HAMMONDS, deceased, the son of OLD PETER HAMMONDS; PETER HIGNIGHT, JOHN HIGNIGHT, MOSES HIGNIGHT, ISAIAH HIGNIGHT, JAMES HIGNIGHT, WILLIAM HIGNIGHT, CATHERINE CAMPBELL, MARGARET EDWARDS and DAVIS, her husband, MARY CAMPBELL and her husband, JAMES, JANE LEWIS and WASHINGTON LEWIS, her husband, these the children and heirs of PHOEBE HIGNIGHT and the daughter of OLD PETER HAMMONDS.

WILLIAM and JOHN HAMMONDS, the only children of JEREMIAH HAMMONDS, deceased, who was a son of OLD PETER HAMMONDS; WILLIAM and MARGARET HAMMONDS, the only children of WILLIAM HAMMONDS, and a son of OLD PETER HAMMONS; G.M. HALE and T.J. HALE, TALITHA HINKLE and her husband, ANTHONY, being the only children of MARGARET HALE, the daughter of OLD PETER HAMMONDS. JOHN HAMMONDS and ISAIAH HAMMONDS, sons of OLD PETER HAMMONDS.

They state that a good many of the heirs are non-residents of Ky.

The Commonwealth of Kentucky to the Sheriff of Knox County. You are commanded to summons: JAMES HAMMONDS, JR., PETER HAMMONDS, DORCAS MCCARTY, JOHN HAMMONDS, EMILY HAMMONDS, ESTHER HAMMONDS, PETER HIGNIGHT, JOHN HIGNIGHT, MOSES HIGNIGHT, ISAIAH HIGNIGHT, JAMES HIGNIGHT, WILLIAM HIGNIGHT, CATHERINE CAMPBELL, MARGARET EDWARDS, DAVIS/DAVID EDWARDS, MARY CAMPBELL, JAMES CAMPBELL, JANE LEWIS, WASHINGTON LEWIS, WILLIAM HAMMONDS, JOHN HAMMONDS (sons of JERRY); WILLIAM HAMMONDS, MARGARET HAMMONDS (children of WILLIAM HAMMONDS, SR.); RACHEL HAMMONDS, MARGARET HAMMONDS (children of OBADIAH); GEORGE W. HALE, THOMAS J. HALE, TELITHA HINKLE, ANTHONY HINKLE, JOHN HAMMONDS, and ISAIAH HAMMONDS (sons of PETER, SR.) to answer in twenty days after the service of this summons on them, a Petition filed against them in the Knox Circuit Court by THOMAS HALE and MARY HALE, his wife, and warn them that upon their failure to answer the petition will be taken for confessed or they will be proceded against for contempt and you will make due return of this summons on the 1st day of the March Term of said Court. THOMAS HALE and wife, plaintiffs against JAMES HAMMONDS and others, defendants, Suit #3 Sept. 8, 1857

The defendants, WILLIAM MCCARTY and DORCAS MCCARTY, his wife, state that said DORCAS is a daughter and heir of PETER HAMMONDS, a son of OLD PETER HAMMONDS, referred to in plaintiffs' Petition and they are entitled by descent to one-eight part of their father's interest in the land belonging to their grandfather, PETER HAMMONDS. That PETER HAMMONDS, the father of DORCAS, and son of OLD PETER, left nine children and heirs, one of whom has since died intestate and childless; and OLD PETER left ten heirs, so that being the interest by descent of these defendants in OLD PETER HAMMONDS' estate is one-eighth of one-tenth.

They further state that in addition to the interest acquired by descent as aforesaid, that defendant, WILLIAM MCCARTY, is entitled to purchase from the other heirs of the father of defendant, DORCAS, to all their right, and title of said estate evidences of which he has in part in his possession in Laurel County and cannot now be filed because they are now in Laurel County and the balance he will procure and all of which shall be filed in due time. He is also entitled to the interest of the heirs of OBEDIAH HAMMONDS, deceased, by purchase. They do not resist a sale of the land belonging to their heirs of OLD PETER HAMMONDS and pray that the proceeds of the same, according to their intent by descent and purchase as aforesaid may be adjudged against them. They pray that the plaintiff be ruled and required to file the title papers or give a definite and accurate description of the land belonging to said estate. They further state the defendant, JAMES HAMMONDS, has never made a settlement of his accounts as required by law: some $175 or two-hundred dollars has been in possession or controlling the possession of the land sought to be sold, ever since the death of the OLD MAN say --- years and the same is reasonably worth the sum of $---- per annum and the defendants have the same interest in the personality and rents which they have by descent and purchase in the land as above stated and said JAMES HAMMONDS has never distributed to these defendants any part of said estate. They therefore make this answer a Petition against JAMES HAMMONDS and pray that he be compelled to account for the reasonable rent of said land since the death of OLD PETER and that he be compelled to settle of his accounts as administrator of aforesaid and on final hearing, they pray for a judgement for their distribution share of said estate, real and personal as well as what they are entitled to by descent or by purchase. They pray for all other proper relief.
