Will Transcript

In the name of God, amen, I Nancy M. Delzell of the County of Botetourt and State of Virginia, being of perfect mind and memory, but knowing the uncertainty of life, do make and ordain this my last Will and testament, in the manner following, to wit:
First, I give and bequeath all my property both real and personal, to my Mother Mary Delzell during her natural life: but if she thinks proper to sell any, or all of my personal property, except my black girl Nancy Howlett, she may do so.
And if the produce or rent of my land is not sufficient to support my Mother, then it is my will, if she desires it, that my land be sold, as hereinafter directed, and from the money thus arising, my Executor hereafter named, shall let my Mother have money enough for her support, from time to time, as she needs it.
3rd. I give and bequeath my black girl Nancy Howlett, after the death of my Mother, to my cousin Matilda Shue, during her the said Matilda's natural life; and at her death, if the said Nancy Howlett is living, it is my will that she shall be free.
3. If the aforesaid black girl should become sickly or unable to work, while living with Matilta Shue, then it is my will that my Executor pay all necessary expenses for attending on her, or for medicine, provided the amount does not exceed fifty dollars.
4th I give and bequeath to the aforesaid black girl Nancy Nowlett, when she becomes free, the sum of one hundred and twenty five dollars.
5th. I give and bequeath to James Fulwiler the sum of three Hundred dollars.
6th I give and bequeath to Mary Catharine Shue the sum of Twenty dollars.
7th I give and bequeath to my Cousin Sarah Sands the sum of two Dollars.
8th I give and bequeath to Martha Elizabeth Delzell, daughter of Hugh F. Delzell Dec'd the sum of Ten Dollars.
9th. I give and bequeath to Nancy Jane Alderson, daughter of Curtis L. Alderson, the sum of Twenty Dollars.
10th I give and bequeath to Nancy Susan Fulwiler, daughter of James Fulwiler, the sum of Twenty dollars.
11th I give and bequeath to my Cousin Mary D. Moore, of Hawkins County, Tennesse, the sum of Twenty dollars.
12th. I give and bequeath to my Cousin Mary Moore, of Hawkins County, Tennessee, the sum of Twenty Dollars.
13th. I give and bequeath to Joseph T. Shue, Twenty Dollars.
14th. It is my will, that immediately after the death if my Mother, my Executor shall, after giving reasonable notice thereof, sell my land, either privately or publikly, if he has not, at the request of my mother, sold ti before, for the best price that can be obtained. And he is, hereby authorized and empowered to convey the same by deed, to the purchaser. And after paying all my just debts, or my mothers, and all necessary expenses, my Executor is to pay the several sums or legacies to the persons before mentioned. But if, after paying the debts and expenses aforesaid, there shall not be money enough left to pay the aforesaid Legacies in full, then each one shall be paid a proportional part of what does remain.
But if after paying the debts and expenses aforesaid, there shall remain a greater sum, then will pay the aforesaid Legacies, then it is my will, that the overplus shall be divided amongst the persons before named, except the black girl Nancy Howlett, in proportion to the several sums left to them.
And lastly, I appoint Curtis L. Alderson my Executor of this my last will and testament.

This instrument of writing purporting to be the last Will and Testament of Nancy M. Delzell deceased was this day exhibited in Court and proved by the oaths of John Anderson and Andrew McCluer subscribingh witnesses thereto, and therefore ordered to be recorded.

A Sale Bill of the real Estate of Nancy Delzell dec'd made the first day of December 1849: 143 Acres of land to Rev. George T. Wilmer, on the following terms, to wit: one third payable on the 1st. January 1850 - one third on the 1st January 1851 - and the residee on the 1st January 1852, the whole Amounting to $2321~
At Botetourt January Court 1850: This Sale Bill of the real estate of Nancy Delzell, dec'd was returned to Court, and ordered to be recorded.
