The Will of Magdalen [Maud] Elkington of Malmsbury ? – 1616
Wife of Humfrey Elkington the elder
In the name of God Amen. The 25th day of February in Anno Dom. 16?? I mause Elkington widow late the wife of Humfrey Elkington of Malmsbury in the county of Wilts, gent. Deceased being sicke in body yet of perfect minde thanks I give to God therefore doe make and ordayne this my Testament in which is contained my last will in manner and form following that is to saye
First I give and bequeath my soule into the hands if Almighty God my creator and my body to be buried in the Church of St. Moles [?] in Malmsbury aforesaid
Item: whereas my husband lately died and made a will and made me whole Executrix if the same which will is not yet proved My Will is therefore that my executors hereafter mentioned shall prove the same will according to law
Item: That whereas my sonne John Elkington was indebted to my husband as apparently by speciality my will is that the one halfe thereof how such ever it be I do freely forgive upon Condicion that he shall pay to my Exsecutors the other halfe thereof.
Item: Whereas my sonne Thomas Elkington was indebted to my said husband one hundred and fifty pounds apparently likewise by specialitie my will is therefore that he the said Thomas shall pay Fiftie pounds thereof unto Humfrey Elkington my sonne and Fiftie pounds more of the same I do freely forgive him upon Condicion thast he shall pay to my Executors the other Fiftie pounds.
Item: I give and bequeath to Richard Elkington my sonne £20 to be paid in manner and forme following viz £5. the Third day of May next and everie sixe months £5. until thje said sume of £20. be fully satisfied and paid
Item: Whereas I owe my brother Edward Parslowe 20 shillings due in lieu of the same 20 shillings given unto him by my husbands best gowne and further I give and bequeath unto him one Dublett a Coate a payre of breeches and a hat which were my late husbands such as shall be thought fitt by my Executors.
Item: Whereas I have here in my Custodie a certain goods of my sister Sarneys my will is that my Executors shall deliver it to her all againe freely and further I do give and bequeath unto her my second best gown my second best petticote a kerchief a Protlett [?] a smocke and a waystcoate and my second berst hatt and a Holland apron.
Item: I give and bequeath unto Thomas Denne William Denne Robert Denne Giles Denne and Walter Denne sone of Henry Denne to every one of them $10 to be paid by my Execuitors within two years next after my decease unto mu Overseers and so by them put firth for their best preferment untgil they severally shall accomplishe the full age of 21 years. And if it happens that they the said Thomas Denne William Den Robert Den Giles Den or Walter Den or any of them shall decease his life before they shall accomplish the asge of 21 years then my will is That the portion of him or them soe deceased shall remayne unto his or them surviving to be equally divided between them.
Item: I give and bequeath to Humfrey Taylor als [i.e. alias] Knott Anthony Taylor als Knott and Alice Taylor als Knott sons and daughters of Thomas Taylor als Knott and to every one of them £10. apiece to be paid by my Executors to my Overseers within two years after my decease by the time my said Overseers to be putt forth for their best preferment until the said children and every of them severally shall accomplish the full age of 21 years and then to be paid unto them with the Increase of the same provided always and my is that any of them the said Humfrey Anthony Mathew Mabell or Alice Taylor als Knott shall decease this life before they or any of them shall accomplish the full age of 21 years that then the portion of them him or she so deceased shall remayne and be equally divided betwixt them surviving.
Item: I give unto William Wickens [?] my servant 10 shillings
Item: I give unto Robt. Wills my servant 10 shillings
Item: I give unto Kate my maid servant 10 shillings to be paid to them within halfe a yeare
after my decease.
Item: I give to the poor people of Burrows [i.e. Borough of Malmsbury] 20 shillings.
All the rest of my goods debts chattels and cattells whatsoever unbequeathed I give and bequeath unto Thomas Den and Thomas Taylor als Knott whome I make my whole Executors to see my debts paid and all funeral exoenses discharged and this my Will truly performed and I do hereby entreate nominate and appoint my well beloved friends Nicholas Archard of Burton Hill Robert Arche Francis Hobbs and Thomas Waite my overseers of this my last will whom I doubt not but will carefully see the same hereby performed as such as then lyeth and I will that this will shall stand and not otherwise.
