Will Abstract

Will of Judith Price of the Town of Staunton and County of Augusta
First of all, after my decease, It is my desire that my body is buried in a decent and christian-like manner at the discretion of my Executor herein after named.
Secondly I will and bequeath my Houses and Lot in Staunton as follows, to wit: Sarah Wallace, wife of Charles Wallace is to possess and enjoy one of the houses, which she may make choice of, for and during her natural life, together with half of the Garden on the Lot; the other house and half the Garden, It is my desire may be annually rented out for the best price that can be gotten, and the money arising from such annual rents to be appropriated towards repairing the tenements when necessary, and towards better support and maintaining of the two daughters of the said Sarah Wallace named Lucy and Susanna Julian; to whom I will and bequeath the fee simple inheritance of the aforesaid Lot, with its appurtenances after the death of their mother, to them, their heirs and assigns forever, or to the surviving one, should either of them decease in infancy or before marriage.
Item, I give and bequeath unto the aforesaid Lucy and Susanna Julian Wallace, one feather bed and furniture each; I give and bequeath unto the said Lucy and Susanna Julian Wallace all the remainder of my personal Estate, that shall be & remain after my decease; saving unto the aforesaid Sarah Wallace their mother, the reasonable use of the estate so remaining, which probably consist in Cattle, ___ to & Kitchen furniture, provided that the said Sarah Wallace shall be liable and forthcoming for the property or remainder of such estate, either in the specific articles, or the Value thereof, unto the said children Lucy & Susanna Julian, as they shall come to age, or marry.
And lastly, for the better or more effectual carrying into effect, this is my last Will and Testament after my decease, I do hereby nominate and appoint Smith Thompson sole executor of this my last Will and Testament, hereby revoking and disannuling all other or former Will or Wills by me made, ratifying & confirming this, and only this to be my last Will and Testament.
In witness whereof I have hereunto subscribed my name and annexed my Seal thirtieth day of June in the year of our Lord one thousand eight hundred and three.

At a Court of Hastings held for the Corporatioon of Staunton, on monday April the 21st 1806.
This last Will and Testament of Judith Price dec. was presented in Court by Smith Thompson the executor therein named, and proved by the Oaths of Vincent Tapp and Delphia Tapp (now Delphia Page), two of the Witnesses thereto; and ordered to be recorded.
And the said executor named in the said Will refused to take upon himself the burthen of the execution thereof; and it appearing to the Court that there are no relations to apply for administration of the same. On the motion of Michael Garber jr. who made Oath, and together with Smith Thompson his Security, entered into and acknowledged their bond in the penalty of One thousand Dollars conditioned as the Law directs; Certificate is granted him for obtaining letters of administration on the said estate with the Will aforesaid annexed, in dur form.
