Will Transcript

In the name of God amen, I Joshua Embree of the County of Gibson Indiana Territory, being weak in body, but sound in mind and memory, calling to mind the mortality of man do make this my last will in manner and form following.
First I lend to my wife Elizabeth Embree the farm on which I now live together with the whole tract except Two hundred acres which shall hereinafter be disposed of, also all the House & Kitchen furniture, farming utencils &c. during the natural life of my sd. wife also I lend to my sd. Wife Elizabeth, my negroes in Kentucky Viz. David, Phillis?, Mary, Gabriel & Peter during her, my said wife's life or widowhood.
Second. I give to my son Coleby Embree one hundred acres of Land part of the tract on which I now live, being the same on which he my sd. son Coleby has and is not improving, Bounded west by the Creek running through my land, South and East by the original lines of the section and extending North for quantity, also the Property which I have already given him amounting by estimation to one hundred & fifty dollars
Third, I give to my son William Embree one hundred acres of Land apart of the tract on which I now live & Parallel to and adjoining my son Coleby's land bounded also by sd. Creek and extending down for quantity, the same to be conveyed and delivered to him at his coming of age.
Fourth. I give to my daughter Nancy Embree One quarter section of L & my sons John Embree, Elisha Embree & Thomas Embree one quarter Section of Land each, to be entered and seuind? to sd. Nancy, John, Elisha & Thomas Embree at their Coming of age ~
Fifth. it is my will and desire that such part or parts of the House hold & Kitchen furniture Stock &c. as is above stated as along to my wife which can in the Estimation of my hereafter named Exrs. be spared from the use of my sd. Wife without injury or distress to her should be given to my above named children as they marry or stand in need of the same, untill the amount by sd. Exrs. estimation equal what my son Coleby has already received of like property and should then not appear to be enough of sd. Property found without injuring my sd. wife, then the remainder must be made up in money, reference being had to sd. Coleby's property as a criterion not taking into consideration his land, as it conceived that the one hundred willed to Coleby & William will equal one quarter which may be procured for the other children as named.
Sixth, it is my will & desire that the Balance or remainder of money, if any, after the necessary number of quarter sections are secured, and all just debts paid, should, also be equally divided amongst the whole of my above named Children.
Seventh it is my will as above stated that at my decease the farm on which I now live, is to be at the disposal of my sd. wife during her life, and should she encline to leave this country or not, the said tract during the term above stated is to be completely and entirely at the disposal of my sd. Wife and for her benefit, & at her death Sd. tract together with all of the above loans, at he expiration of sd. loan is to revert back into the hands of my Exrs. who are hereby directed and required to dispose of, or divide in any manner which they, my sd. Exrs. may at that time think most advantageous to my sd. Children.
Eighth it is my will that Jesse Emmerson & my son Coleby Embree should act as Executors of this my last will and testament.
