Will Abstract
- Will of John Winton of the County of Roane and State of Tennessee
- 1st. Names "beloved son William Winton the tract of land on which he formerly lived on the north side of Tennessee River made to him by deed of conveyance and all my right of the third part of my Island on the opper end".
- 2nd. Names "beloved son James Winton the tract of land on which he now lives made to him by Deed of conveyance one other tract of land adjoining the tract of land formerly owned by James Blair and also adjoining tract of land on which said James Winton now lives running out to the top of the ridge also my surplus land below south of the ridge adjoining John White's land and Allen Haley's land.."
- 3rd. Names "my beloved children John and Mary Montgomery the tract of land on which the said John Montgomery now lives made to him by deed of conveyance and all my right of the second lot in my Island being one third part of said Island..."
- 4th. Names "my beloved son John Wesley Winton the tract of land the said John W. Winton now lives together with all my land on the south side of the top of Fork Creek ridge and bounded as follows: Beginning on a black Jack Joseph Granenier's corner thence north fifty eight & three fourth East one hundred twelve & nine tenths chains to three chestnuts Jacob B. Keener's corner and with his line south thirty eight and one half east ninety three and six tenths chains to a large pine corner to Benj. Prater and with his line south fifty three & one fourth west three and eight tenths chains to a small pine then south fifty eight chains to a pine thence north sixty five east seventy two & and one half chains to a hickory on the bank of Holston River thence down the River south eleven & three fourths East fifty six chains to large white oak thence north sixty eight west twenty six and six tenths chains to a pine thence south sixty four est fifty chains to a hickory bending with Benjamin Prater's one the two east lines thence binding with said Prater..."

Names "my beloved daughter Elizabeth Montgomery and her children all of a tract of land lying in Hamelton County on the Waters of North Chickamauga and Tennessee River together with my right to the Island at the mouth of said creek in said river including the whole of my claim of land in that County all of which was sold by William Montgomery to George Sawyer in said Montgomery's lifetime as the Deeds will Show also an equal divide with my other children of my stock property and money on hands not otherwise disposed of at my decease."
- 6th. Names "my beloved son Bobby Winton all of my home tract of land and bounded as follows..."

Names "my beloved children Samuel and Nancy Johnson the tract of land they now lived on including eight quarters as granted to me bu the State of Tennessee with all the appurtenances to the same belonging and all my right of one third part of my Island being the lower end of said Island also an equal divide my other children of my stock property and money on hand not otherwise disposed of at my Decease."
- 8th. Names "my beloved children John and Dolly Grant the tract of land on which they now live bounded as followeth viz. Beginning on a willow on the bank of Muddy Creek on the South East side of Blairs Ferry road corner to Martin Powell and my homeplace thence up various meanders of said creek to a stake in what has been called Lewis & Lenoirs line where said line crosses the creek thence with said line south to a small maple corner to Thomas Praters Price tract thence east fifty two and four tenths chains to a Post Oak & Black Oak Prices old corner thence south ten east with Thomas Prater's line of his Price tract crossing fork creek to the top of said ridge east wardly to a Blackjack Joseph Grammers corner thence with said Grammers line north fifty three and one half west to a small white oak in the room of three dead pines thence a direct line northwesterly to a stake Elkins corner... also two negroes viz Wilson and my girl Mary also an equal divide with my other children of my stock property and money not otherwise disposed of at my decease & also give and bequeath to my beloved children John and Dolly Grant all my right to any surplus land as made to the said Grant by Deed in the following bounds viz Beginning at the Salt Petre cave on Holston river and thence with the county line between the County of Knox and Roane to Clinch River thence down said river to the mouth of Paw Paw Creek thence a direct line to where one Jacob Baker had a black smith shop on Tennessee River thence up Tennessee and Holston river to the Beginning except any scraps of surplus lands which may be among or adjoining my land on the waters of Muddy and Fork Creek"
- "I also bequeath to my beloved children John Wesley Winton, Bobby Winton and John and Dolly Grant all the land I own south of my home place and on the waters of Fork Creek to be equally divided between them so as to give each his lot adjoining his other land as they can agree among themselves the lands above refered to formerly owned by Jacob Elkins, Allrick Keener and others. I wish my Executors to sell all the land I own with the appertenance to the same belonging on the south side of Tennessee river in the neighborhood of James Hornsby and my son in law Samuel Johnston which are not bequeathed in this my last will and Testament to the best advantage and divide the money equally among my children at my Decease."
- "I also wish my Executor at my Decease to sell my Mills and land on the waters of Muddy Creek including my Mill place to which are not bequeathed in this my last will and Testament at sale in my family among my children or their legal representatives the highest bidder who can make good to the payment to be the purchaser."
- "I also wish my Executors at my decease to sell my Negro woman Liza and boy Henry at sale in my family among my children or their legal representatives the highest bidder who will make good the payments to be the purchaser to be sold together or separately at the discretion of my Executors."
- "If my agents Bobby Winton and John Grant shall not sell a tract of land I own in Anderson County called the Sutherland land where my son George Winton lived all his decease during my lifetime I wish my Executors to sell said land so soon as they can to advantage and divide the money equally among my children or their lawful representative>'
- "As it has been convenient for me to make a division of money with my beloved children I think it proper at this time to state the sum each one has received in silver viz: William Winton five hundred dollars, James Winton five hundred dollars, John & Mary Montgomery five hundred dollars, Bobby Winton five hundred dollars, Samuel & Nancy Johnson five hundred dollars, John & Dolly Grant seven hundred dollars and each of my children named above have in a divide of Horses received one except William Winton."
- "As it respects to relation of my negro woman Kitty, she shall serve no person as a slave after my Decease. i wish my sonBobby Winton to take care of the above named woman kitty and see that she is made comfortable and if said Bobby Winton shall not discharge his duty in this case I wish my Executors to see that the said woman Kitty is comfortably provided for during her lifetime in decent manner out of property or money of the share of the said Bobby Winton."
- "I wish my Executors to give at my Decease to my black women Kitty, Eliza and Mary each five dollars."
- "I wish my Executors at my decease to give my watch to my son William Winton and my gun to my grandson John Asbury Winton."
- "As I do not wish a public sale to be made of my personal property I wish my Executors to dispose of my personal property in my family at sale among my children at their lawful representatives the highest bidder to the purchaser - I also bequeath my meeting house on Muddy Creek and all the land of the meeting house site to the use and for the benefit of the Methodist E. Church as long as they shall keep up a regular church or society at the said place of worship and keep up the meeting house for worship. In case the Methodist E. Church should finally remove worship from the said meeting house to some other in the neighborhood that they deem convenient in that case my Executors shall have full power to confer the favor of said house to the Cumberland Presbyterian Church should keep up a regular place of worship in said house...."
- "Being sound in mind and memory at the time I think it my duty to have every part of this my last Will and Testament attended to by appointing for my Executors (viz) James Winton, John Wesley Winton and in case of the death of either of them my Son-in-Law Samuel Johnston is appointed to assist the other as third Executor..."
- "The sheets on which this my last Will and Testament are written are sticked together and the pages numbered all in the hand writing of John Grant under my hand and seal."
- "In the year of our Lord one thousand eight hundred and forty two and on the ninth day of February."

- State of Tennessee County Court Roane County, August Term 1846
- The was the forgoing last Will and Testament of John Winton Deceased produced in open Court and the Execution and declaration thereof duly proved in open court by the oaths of Martin Powell and John Grant two of the subscribing witnesses thereto and John Grant being one of the devisees named in said Will for the same is continued for further proof.
- Witness my hand at office in Kingston this 3rd day of Aug. 1846.

- Then was the foregoing last Will and Testament of John Winton Deceased again produced in Court and the Execution thereof duly proved by the oath of Jesse Wilson the other subscribing witness thereto and admitted to record and ordered to be certified and recorded witness my hand at office in Kingston this 7th day of September 1846.
