Will of John Weaver

In the name of god amen I John Weaver Snr of Madison County do make this my last will and testament I do lend my loveing [sic] wife Barbara Weaver my house and Plantation and five of my slaves such as she chose and yous [sic] of my House such as she will chose and cattle as many as she will chose and House furniture and plantation tools during her life

Item my will and desire that my son John Weaver Jun shall have the Land where he now lives on and after the death of my wife he is to have all the track [sic] where I and he lives on and them ten acres as I purchast [sic] of Peter Weaver and one hundred acres of that Track [sic] I purchast [sic] of Jacob Rasor to him and his heirs

Item my will and desire that my son Aaron Weaver shall have that track [sic] as I purchast [sic] of Henry Crisler and twelve acres of that Track [sic] as I purchasd [sic] of Jacob Rasor and one hundred acres of my mountain Land

Item my will and desire that my son John shall have choice of the track shall have two hundred acres of my Mountain Land

Item my will and desire that my daughter Marget [sic] Clore and the heis [sic] of her body is to have two hundred acres of my mountain Land Item my will and desire that my son Aaron shall not sell nor trade this track [sic] of Land I will him of Rasors and Crislers and if he should die without any heir my Grand son William Weaver is to have his Land

Item my will and desire that I give my daughter Marget Clore and the heirs of her body one Negro names Moses

Item my will and desire that I give to my daughter Mary Rouse and the heirs of her body one Negro Boy named Isaac

Item my will and desire that I give to my daughter Hannah Blankenbecker and the heirs of her Body and all her Estate to she [sic] heirs of her body one Negro boy named Ned Item my will and desire that I give to my son John one Negro named Bill

Item my will and desire as my son Aaron shall have one Negro man named Richard

Item my will and desire that Elizabeth Baker shall have forty pounds out of my Estate

Item my will and desire that the balance of my Estate shall be equally divided among my sons and daughters

Item my will and desire that my son John shall be overseer and manage business for my wife

Item my will and desire that those thing [sic] I lent my loving wife what remains after her death all except the Land that I have willed to my son John Weaver Jun shall be equally divided among my sons and daughters

Item my will and desire that my Slave Henry should be hired out by my Executors whom I shall name hereafter as long as my wife sall [sic] live

Lastly I do nominate and appoint Cornelius Carpenter and my son John Weaver Jun Executors of this my will and I do hereby revoke and disannull all other wills by me heretofore made declaring this only to be my last will and Testament

In Witness whereof I have herunto set my hand and seal this Twenty eight day of May in the year of our Lord one thousand eight hundred and four.

A Codicil to this my last will, after my death and the death of my son John my desire is that he the said John shall pay each of my said daughters, Margaret, Mary & Hannah Ten pounds each.

My will and desire is that my Negro woman Nell at my death shall go to my son Aron [sic] if the other children is Satisfied.

At a Court held for Madison County the 23rd day of April 1807.

The Last will and testament of John Weaver Sen deceased was exhibited into Court and proved by the oaths of Adam Utz J and William Wilson two of the Subscribing witnesses thereto and ordered to be Recorded and on the motion of John Weaver one of the Executors therein named Certificate is granted him for obtaining a probat [sic] thereof in due form. Whereupon he qualified and gave bond and Security according to Law.

Know all men by these presents that we John Weaver Adam Wayland and Michael Yager are held and firmly bound unto Merry Walker, Daniel Field John Hume Daniel James and William Mallory, Gentlement Justices of the Court of Madison County now sitting in the sum of Ten thousand dollars to the payment whereof well and truly to be made to the said Justices and their Successors we bind ourselves and each of us, our and each of our heirs executors and administrators, Jointly and severally firmly by these presents, sealed with our seals this 23rd day of April in the year of our lord 1807 and in the 31st year of the Commonwealth.

The condition of the above obligation is such that if the above bound John Weaver Executor of the last will and testament of John Weaver Sen deceased do make or cause to be made a true and perfect Inventory of all and Singular the goods, chattels and credits of the said deceased, which have or shall come to the hands possession or knowledge of him the said John Weaver or into the hands possession or knowledge of any other person or persons for him and the same so made do exhibit, or cause to be exhibited in the County Court of Madison at such time as he shall be thereunto required by the said Court. and the same goods chattels and credits, and all other the goods chattels and credits of the said deceased, which at any time after shall come to the hands possession or knowledge of him the said John Weaver or into the hands or possession of any other person or persons for him do well and truly administer according to Law and further do make a Just and true account of all his actings and doings therein, when there unto required by the said Court, and also shall well and truly pay and deliver all the legacies Contained and Specified in the said Testament as far as the said goods, chattels and credits will thereunto extend, and the law shall charge, then this obligation to be void and of no effect, else to remain in full force and virtue John Weaver

John Weaver (Reference # 386 & 398) was born c1728 in the part of Spotsylvania Co. that is now Madison Co., Virginia and died after 1762 when he patented land in a part of Culpeper Co. that is now Madison Co., Virginia. He married Barbara Kaifer (Reference # 387 & 399) in Virginia. For further information on Barbara Kaifer's ancestry see the Kaifer Family. They had the following children: Margaretha Weaver b. 19 December 1752 at Culpeper (now Madison) Co., VA d. 24 December 1814 m. Michael Clore (1 December 1746-7 December 1817) at Culpeper (now Madison) Co., VA Maria Weaver b. 3 May 1755 at Culpeper (now Madison) Co., VA Hanna Weaver b. 15 August 1757 at Culpeper (now Madison) Co., VA John Weaver b. 10 February 1761 at Culpeper (now Madison) Co., VA m. Elizabeth and had the following children: Jonas Weaver (18 November 1788-); Thomas? Weaver (10 June 1791-) and Simeon Weaver (27 March 1795-) Aron Weaver b. 6 March 1763 at Culpeper (now Madison) Co., VA
