pp. 57 This Indenture made 11th/12th September 1723 between JOSEPH WAUGH, DAVID WAUGH and PRISCILLA HAY Widdow Surviving Executors of the Last Will & Testament of JOHN WAUCH of County Stafford Gent. deceased of one part and the Reverd. ALEXANDER SCOTT of said County Clerk of other part .-Witnesseth that whereas John Waugh aforesaid by his Last Will & Testament bearing date 8th October 1716 duely proved in Stafford County among other things ordered that his Executors should sell sundry lotts in the town of Marlbrough with the lands and edifices thereon as also 1000 acres of land upon Wolfe Run in the said county Stafford in these words following vizt; Item it is my Will and meaning that my lotts in the towns of Marlbrough with the lands and edifices thereon be by my Executors sold and disposed of for the good of my children and the product thereof wholly to return to them and also one thousand acres of land granted to me by Pattent from the Proprietors office lying upon Wolfe run which I leave in the like manner to be disposed of by my Executors and the pro-duct thereof to be putt for the use of my children .. Now this Indenture Witnesseth that the surviving Executors of the Last Will & Testament of John Waugh deced for Tenn thousand pounds of good tobacco and the within mentioned sum of five shillings Sterling doth sell 1000 acres part of a parcel bounded . Beginning at a red oake standing by the side of Wolfe Run .. being laid out for 1025 acres and being granted unto John Waugh deced by pattent bearing date 25th of ffebruary 1709 the said 1000 acres part of the said 1025 being left to be sold .. Waugh .. doth further agree that John Waugh an Infant under the age of 21 years oldest Son of the said John Waugh deced shall as soon as he shall arrive to full age of twenty one years .. or in case John should die before arrive at 21 that then the next surviving son of the said John Waugh the Father deced shall be right heir unto the said John Waugh -. acknowledged in county court of Stafford or in case the said County of Stafford shall be divided then in the County where the said 1000 acres of land shall lye and be such further deeds for the conveying presence
