Will Transcript
- In the name of God amen, I John Newman of the County of Shenandoah and state of Virginia being of sound mind and memory and considering the uncertainty of this mortal life do make and publish this my last will and Testament in the manner and form following. That is to say I first will and devise that all my just debts and funeral expenses shall be paid out of my personal estate.
- I give and bequeath unto my beloved Wife Mary Newman all my land, Negroes, and personal Estate during her natural life to carry on the Farm and support and educate my children the same as if I was present myself.
- And whereas my son Joseph M. Newman has received a medical education at my expense and my son George S. Newman has commenced the study of Medicine, I might not have funds in cash sufficient to complete his education, it is my will that my wife sell some lots of Land I purchased from the heirs of David Strickler Dec'd. that is one lot of about forty acres of Mountain Land one of twelve and one fourth in their home place, and two undivided shares in the widows dower of said place of so much thereof as he may want to complete my sons George S. Newman's Medical Education and when that shall have been completed it is my opinion at this time that Joseph & George will have received their full shares of my Estate in consequence of their having received it so much in advance of the others.
- All my other Land not mentioned above Negroes and personal Estate I give to my other six children after the death of my Wife. That is to Catharine N. Williams, Francis M. Newman, Walter N. Newman, Sarah Ann Newman, Phebe Ann Newman and John S. Newman to be equally divided amongst them and any sum of money that may be charged to any of my children by me or my wife in a book kept by me for that purpose shall be considered as so much received of my Estate.
- And if my wife should at any time after my youngest son arives at lawful age decline to carry on the farming business she is permited to do so, and in that event the whole of my Land, Negroes and personal estate be sold and equally divided among my six last named children and my wife she having an equal share to dispose of as she pleases.
- And lasstly I do hereby constitute and appoint my Wife Mary Newman Executrix of this my last will and Testament, hereby revoking all former and other wills made by me and declaring this and this only, as and for my last will and Testament.
- In witness whereof I have hereunto set my hand and seal this twenty seventh day of November in the year of our Lord one Thousand eight hundred and thirty six.

- Signed sealed and acknowledged to be his last Will & Testament in the presence of Moses Walter, Samuel Newman, Ann Newman, Jno. W. Rice
- Be it known that the provisions made my for wife in the foregoing wills are made presuming that she will not marry: but in the event that she should marry then the whole of my Estate to be sold when my youngest son arives at lawful age and the money equally divided among my last named six children and my Wife, she having an equal part to dispose of as she pleases.

- At a Court held for the County of Shenandoah on Monday the 12th day of August 1839. The last Will & Testament of John Newman dec'd with a codicil annexed and produced into court and the said Will and codicil proven to be in the hand writing of the Testator by Moses Walton & Saml. Newman witness thereto and was published pronounced and declared in their presence as his last will and Testament which is ordered to be recorded. And on motion of Mary Newman the Executrix therein named, who was sworn and entered into bond with Reuben Moore, Saml. Newman & Geo. F. Hupp as here securities in the penalty of $15,000 conditioned according to Law.
