Will Transcript

I John Key of the County of Albemarle and State of Virginia, considering the uncertainty of this life and wish to dispose of my worldly estate which I am in possession amongst except what I have already given which I shall below mention do this twenty sixth day of August, Eighteen hundred and eleven do Make and Ordain this to be may [sic.] Last Will and Testament evoking and making void all and every will or wills heretofore by me made.
I give and bequeath to my Daughter Polly Bibbs Blacks then negroes she has or ought to have i possession, viz. Tom, isaac & Earke {?] with all this in Orease [?] to her heirs forever upon the following condition, that is to say that br [?] the said John C. Blachy nor Polly nor no other person claiming under them shall ask, demand any further sum of money or claim any negro or negroes from my Estate them the above he do hereby, and they forfeit the above negroes and their increase or the value of them which fit to the values of three hundred pounds, which my hereafter mentioned children have a full demand for - also the same right to demand and recover the sum of three hundred pounds which sum I have advenced to him and his use some years ago, which sum I consider a full proportion of my Estate, if they are satisfied, i then give it to them and their heirs forever.
I give and bequeath to my son Strother Key the Negroes that are mentioned in the deed of gift ___cutin [?} by me to him sometime last year to velue of hour hundred and Eighty pounds to be considered in teh division of my Estate to him adn heirs if any lawfully begotten of his own body to him & them forever.
My son John Key is in the division of the Estate to amount for the sum of two hundred & fifty pounds.
I give and bequeath to my son Richard Winn Key one negro fellow by the name of Abram upon the following conditions, that is to say for his and wife's, if any, use, that he has no right to sell or any other way to hire or sell or dispose of him or his laborer, but for himself & his wife or heirs own use without the approbation of one or more of my Executors hereafter mentioned.
Will and charge Jesse Bibb Key with the sum of one hundred and fifty pounds being for lands in Chided of Mim [?] in the land that he sold to Peter Minor as was the sold cause of my get his grandfather Martin Key to will the said cause to him its nothing but eight, but it should be considered as a gift immediately from me that and the above __ for More than I am able to give the other children should he did without an heir and leave his eatate to any other person beside his brothers and sisters, then I will that my Executors do demand, secords any way they plan the above sum of one hundred and fifty pounds, with interest forever the 1st day of January 1810, divide the same amongst my, these living children or their heirs if any they have.
Lastly as at this time my Estate as partly him and part in the State of Tennessee State, and my business on each unsettle base, I think fit and do appoint Joseph [scratched out] Jesse Bibb Key and John Watson my Executors in this state to act and do the business of the Estate & Cosse [?] this will as for as it will appertthin [?] duly, without giving the Court any security for these __dunt - and do further appoint Strother Key and John Key for my Executors in the State of Tennessee to see and carry this my will into at conditions.
Should I did before I move to Tennessee and teh will proved in Albemarle Court that a copy of this will from their Court shall fully authorise Strother Key and John Key Jr. to all there and here as they may convasent upon the same terms as Jesse Bibb Key and John Watson to heirs and other.
item. I just think very proper to dispose of any of my children's property that may die without lawful heir, the estate of such child or children that come by me or through my means shall be divided amongst those that him ordain and so in proagnlaion [?]

P.S. Thou'er several works interlined by myself, viz., the line any, 15 thru, 18 children in the same line the word Jane no witness present to attest this will and wrote, wltogether with my own hand I hope and desire the Court will admit it to record.
State of Tenesee [sic]
Sumner County Court February Term 1814 the last will and testament of John Key was exhibited in Court for probate and there being no subscribing witnesses there to be the same was proved by the oath of William Smith and William White.
The last will and testament of John Key dec. was exhibited in open court for probate and there being no subscribing witnesses thereto the same was proved in due form by the oaths of John Waters and the said will having been also proved in dur form at a __vions day this term by the oaths of William Smith, William White and the_ upon the said will is ordered to be recorded.
