Will Transcript

John R. Hayden's Will
Pleasant Hill, Bolivar, Va., June 22d 1828
In the Name of God, Amen. Being in sane mind & memory & my health not being good. But knowing the uncertainty of life & certainty of death, and that 'tis appointed once for all to die, this reason has determined me to write this my last will & testament.
First, I bequeath my Soul to God, who have it & my body to mother earth from whence it came.
2d. after paying my just debts out of my loose property and also tending? debts due me the balance if any left to be placed in some banking institution that will be safe on in-trust for the purpose of educating my two sons William Warden Warren and Marcellus Montgomery these to remain deposited at six per cent per annum Or if that cannot be done to be placed in the hands of some individual at six per Cent per Annum and a deed of trust to ___ to secure the same and On failure of paying the interest, every three or six months at farthest proceed to sell to raise the money. My object for this arrangement is to have funds in such as situation that they can be handled when wanted & as they arrive at the age of twenty one let them receive their part equally.
3d. To Scotia, my dear wife, I give my residence, Pleasant Hill with my household & kitchen furniture, so long as she remains my widow, but when she ceases to be my Widow, by Marriage, then what the Law allows her, except such things as are otherwise disposed of also one negro Girl woman & a boy, Samuel during her natural life, or widow-hood. The framed Building to be rented & the funds are to be applied to the support & education of my sons.
4th. I give to W.W.W. my eldest son, my black boy Samuel, my watch & Suretary? & Book case
5th. I give my Son M.M. a negro Boy equal in value to W.W.W. boy Samuel, my Plate also
My medical Library, if it will bring half its original cost, Sell it. But if it will not, then keep it for W.W.W. provided he chooses to be a Physician & likewise my Surgical instruments are to be placed in the same situation. But if W.W.W.H. does not choose the profession of a Physician & M.M.H. does, then he is to inherit the Medical Library & instruments, and if they should choose both the above profession, then equally divide them between them. But in either case they must be taken good care of, & not loaned to be injured.
My other Books may be sold, except my large Holy Bible, which I have already given to my dear wife, & Hervey's Meditations, & any other Theological work she may wish to keep.
My medicines both private & in my Drug Store together with every thing in & connected with my Store, I wish sold on a credit of Twelve Months, provided the Situation of my affairs will justify so long a credit.
I also, if my wife would prefer leaving Pleasant Hill & it should be ascertained that it would bring a good price, I then would prefer having it turned into cash & the money placed in the Situation above spoken of: of Loaning securely & taking Deed or Deeds of Trust to secure the payment of the money as before stated. My Lewis Land I would like to have it Leased out until it is well improved, or untill it would bring its value & if so the funds to be placed in a like situation. If the real Estate should be sold, of coarse [course] my my [sic] widow would be entitled to her thirds & that should rest with herself whether to take it all at once, or receive it quarterly or semi-annually.
Those Notes I hold on George A. Hayden I wish to be considered cash lent & for him to pay the interest semi annually, that is take up the old notes & give new ones & then be subject to pay the interest as stated, until my Son W.W.W.H. comes of age & then pay up the money to him. But of this be only shall receive his equal half when his brother M.M.H. comes of age & account to him for it.

At a Court held for the said County, on the 21st day of January A.D. 1839, this Last Will & Testament of John R. Hayden, deceased, was proved to be entirely in the handwriting of the Testator by the oaths of Isaac Fouke and Horatio N. Gallaher and ordered to be recorded.

    Dr. Jno. Ramsey Hayden born July 25, 1797 died August 31, 1838, married Scotia Warden, February 7, 1822. She was born October 9, 1800. Her father was William Warden born July 9, 1749 his wife being Sarah Chrisman born May 18. 1757. John and Scotia's children: Charles Massena, Marcellus Montgomery; William Warren Warden and John Ramsey Jr.

    Dr. Geo. Anson Hayden born March 21, 1800; married Adaline Beeler April 24, 1828; died November 14, 1828. Both Dr. John Ramsey Hayden and Dr. Geo. Anson Hayden are buried side by side in the old Harper Cemetery at Harpers Ferry, W.Va. They had a drugstore in Harpers Ferry and Dr. John Ramsey Hayden's will is on record in the Court House at Charles Town, Jefferson County, W. Va. I do not know where his wife Scotia Warden is buried but should like to know.
