Early Land Acquisition in Virginia

Northern Neck Land Grants, Book O, Page 109 - The Right Honorable Thomas Lord Fairfax - Baron of Cameron in that Part of Great Britain called Scotland Proprietor of the Northern Neck of Virginia. To all to whom this present writing shall come sends Greeting - Know ye that for good causes for and in consideration of the composition to me paid and for the annual rent herein after reserved, I have given, granted and confirmed and be these presents for me my Heirs and Assigns do give, grant and confirm unto John Davis of Frederick County, A Certain Tract of Waste and ungranted Land near Potomac in the said County and bounded as by a Survey thereof made by John Mauzy - Beginning at a White Oak the beginning of 1175 acres of land granted to James Davis and also a corner to Bernet Newkirk thence N 80 E 59 poles to a black oak corner to the said Newkirk thence with another of his lines S 22 E 106 poles to a black oak his corner thence leaving his land S 53 W 122 poles to a stake corner to Robert Davis Sr Patented line thence along the same N 163 poles to the Beginning, Containing 70 acres. Together with all rights, members and appurtenances thereunto belonging Royal Mines excepted and a full third part of all Lead, Copper, Tin, Coals Iron Mine and Iron Ore that shall be found thereon. To have and to hold the said 70 acres of land together with all Rights, Profits and Benefits to the same belonging or in anywise appertaining Except before excepted. To him the said John Davis his heirs and assigns forever. He the said John Davis his heirs and assigns therefore Yielding and Paying to me my Heirs or Assigns or to my Certain Attorney or Attorneys, Agent or Agents or to the Certain Attorney or Attorneys of my Heirs or Assigns, Proprietors of the said Northern Neck Yearly and every Year on the First Day of St Michael the Archangel the Fee Rent of One Shilling Sterling Money for every Fifty Acres of Land hereby granted and so proportionally for a greater or lesser quantity. Provided that if the said John Davis his heirs and assigns shall not pay the said reserved annual Rent as aforesaid so that the same or any Part thereof shall be behind and unpaid by the Space of two whole years after the same shall become due. If legally demanded that then it shall and may be lawful for me, my Heirs or assigns, Proprietors as aforesaid, my or their certain Attorney or Attorneys, Agent or Agents, into the above granted Premises to reenter and hold the same so as if the Grant had never passed. Given at my Office in the County of Frederick under my Hand and Seal. Dated the sixth Day of January 1768.

Frederick County, Virginia, Deeds, Book 13, Pages 387 & 388 Lease & (Release) - 6 Aug 1770, Between John Davis of Fredreick County to George Miles of County aforesaid... consideration of 5 shillings (£25)... tract of land and being near the Potomac... as by a survey thereof made by John Mauzy... corner to Barnett Newkirk... corner to Robert Davis Sr... containing 70 acres more or less... Frederick County, Virginia, Deeds, Book 13, Pages 389 & 390 Lease & (Release) - 7 Aug 1770, Between John Davis & Elizabeth his wife of Frederick County to John Potts of the same County... consideration of 5 shillings (£15)... tract of land lying in Frederick County and is part of a tract of land containing 340 acres granted to said John Davis the 29th May 1769... containing 25 acres more or less... rent of one peppercord on the 29th Sept if same be lawfully demanded... Berkeley County, Virginia, Wills, Book 2, Page 364 - Written 29 Sep 1777. Proved 27 Jun 1796/
In the name of God Amen, I John Davis of Berkeley County in Virginia being in perfect health and sound memory thanks be to God for it but knowing that it is appointed for all men once to die I therefore do will and dispose of what estate it hath pleased almighty God to bless me with in this life in the following manner. :First, I will that all my just debts be first paid and discharged.
Item, I will that my wife have the whole sole benefit of all my lands and tenements until my Eldest son James comes to age and the part that I will to my son Joseph until he comes to age and all my moveable or personable estate to her, she paying such legacies as is herein after mentioned.
I will that my son James have the land I have a patent for from Lord Fairfax on the East side of Tullises Branch with a piece of Bottom out of the old patent as far up said Tullises Branch as to a lane from my now dwelling house to the line to him and his heirs forever.
Item, I will to my son Joseph all the remainder of my lands and tenements to him and his heirs forever.
Item, I will that my eldest daughter Sarah have £20 paid to her when she comes to age.
Item, I will that my daughter Ruth have £20 paid to her when she comes to age.
Item, I will that my daughter Drusila have £20 paid to her when she comes to age.
I will that Mary, my youngest daughter, have £20 paid to her when she comes to age.
I do appoint Elizabeth, my wife to be whole and sole executor of this my last will and testament. Ratifying and confirming this and no other to be my last will and testament. Disallowing all former wills or legacies by me named or mentioned.
