notes on 1840 census: Jesse Shults in Sugarloaf, Columbia Co, PA. We only get age info. He is between 20 and 30. That matches. He has two male children under 5. That matches Joseph and C.A. One female in the house between 20 & 30. That matches Hannah. One female in the house under 5. That matches Lucinda. Not proof that this is the same Jesse 10 years later in Hayfield, but everything seems to match up.

Oh, and one more thing. The next househould in Sugarloaf after Jesse Shults. Yes, Samuel Shults.

  3. Jesse K. Shultz died on 21 Aug 1853 at the age of 41 yrs 11 mon and 21 days according to a cemetery stone...He is actually listed as J.K. Shultz. I am assuming this is him.
  4. I found Juniata Twp Watrousville Cemetery with Andrew Shults death 18 Jan 1873, Lucia E. Shults date of death 22 Aug 1867 at age of 27 years the wife of Andrew. Then there is Hannah Schultz date of death 10 Dec 1865 50 years old. A J.K. Schultz date of death 21 Aug 1853 at the age of 41 years old. Also a C.A. Schultz CO. A.F. 2nd MI inf.

    also in his probate file, Dr Johnson filed a bill against the estate in 1866 for treatment of jk shultz at his death in '1852 or at his date of death'. it sounded like he was unsure of the exact date.
  5. File 1-89, Estate of Jesse K Shultz:
    We show Jesse Shultz dying in 1853, but the probate file was opened in 1866. Hannah, Jesse's wife died in Dec 1865 which is what triggered the probate, because now the real estate had to be disposed of. I think that the prevailing law is that the real estate belongs to the husband, but the wife can stay there until she dies, then it goes into probate. Many of the papers mention the estate of both Jesse K Shultz and C Albert Shultz, deceased. (he is also referred to as Albert Shultz or Charles Albert Shultz on one paper). C Albert is one of Jesse's sons on the census, so apparently he died between 1860 and 1866. There is also a reference to the estate of Hannah Shultz. So apparently all 3 people are included in this one file.
    Jesse Fox was appointed guardian of the minors; Thomas Shultz, Harriet Shultz and Jesse Z Shultz. (Jesse Z is child I had not heard of before, but when we get to the heirs Jesse Z is not mentioned. (one doument mentions Zaphaniah but is signed Jesse Z, so apparently those two names refer to the same person)
    What I found odd, is that the date of death is never mentioned, it is always the previously deceased, so I would guess that the date is not important to the probate court. Fortunately one of the receipts for services rendered listed an approximate date for Jesse's death. William Johnson, apparently a Doctor billed the estate for services performed on Mrs. Shultz at her death in December 1865; he also added to his bill "surgical services provided to Mr. Shultz in 1852 (or at the date of his death)"
    So, who are the heirs?
    Lucinda Fox (purchased the rights of Joseph Shultz), Mary E Russell of Juniata (must be daughter Mary, did not have a husbands name before) (Henry E Russell is the administrator of the estate; could that be Mary's husband?), Thomas Shultz of Fairgrove, Harriet Shultz, Zaphaniah Shultz and Albert A Smith (this would be Emily's child).
    Lucinda Fox. Jesse's daughter Lucinda married Jesse Fox. Jesse Fox is also the guardian of 3 minors. So, I would presume that Lucinda is an heir in her own right, in addition she purchased the rights of Joseph. There is a receipt where Joseph Shultz signed for his share of the estate of C Albert Shultz. He received $48.84. It is signed Joseph O. Shultz.
    58 papers in the file, some of them written on both sides, so a lot to look up. Other items of interest.
    Gearhart Kile filed an objection to the sale of the estate in that it was not handled fairly. He stated that he was prepared to offer $2000 for the real estate, as were other people and that it was sold for too little. Gearhart apparently wanted to purchase the estate using credit terms for part of the payment, which is why his bid was not allowed.
    The auctioneer filed a statement that the sale held at the hotel of G.W. Buddington of Watrousville was conducted fairly. He obtained a bid of $1662. He announced to everyone in the room, that if he did not receive a higher bid he would close the sale. He then closed the sale. The judge ruled that the sale was conducted fairly.
    Gearhart Kile filed to be appointed guardian to Albert A Smith. He paid $500 and was appointed guardian. I had though that Gearhart and Nancy took the child in right away upon the mothers death, but looking at the dates on the papers it was over a year later. So apparently, Albert lived in the Hannah Shultz household until Hannah died in December 1865, then Gearhart and Nancy stepped in.
    There was also a petition filed by Jesse Fox that Henry E Russell had concealed and disposed of certain assets.
    There is also a note that papers are missing from the file.
