IN THE NAME OF GOD AMEN I JAMES NOELL of the County of Essex being in perfect sence and memory thanks be to Almighty God and calling to mind the mortality of my body doe by these presents make this my last Will and Testament Revoking all former wills that shall appear hereafter Viz.
ITEM I give and bequeth unto my Son JAMES NOELL all the land lieing on the North side of Occupasia Run and Lying between HAMTONs BRANCH and the branch next WILLIAM VICREY old field being one hundred acres more or less to him and his heirs forever.
ITEM I give and bequeath unto my Son CORNELIUS NOELL all the rest of my land lieing on the North side of Occupasia Run and between the aforesaid branch next VICKREY old field and THOMAS RAMSEY Spring Branch and the land I purchased of WILLIAM VICKREY being by Estimation Eighty acres more or less to him and his heirs forever.
ITEM I give and bequeath unto my Son JOHN NOELL all my land on the South side of Occupasia Run being one hundred acres more or less to him and his heirs forever. It is my will that my Son CORNELIUS shall have Timber of the land I have given to my Son JOHN for the use of his Plantation for the term of Seven Provided my Son CORNELIUS should sell his land then the purchaser shall have the priveledge of any Timber of my aforesaid Son JOHN land.
ITEM I give unto my Son EDWARD NOELL fifty three acres of land which I purchased of ABNER GRAY to him and his heirs forever.
ITEM I give unto Two Sons JOSEPH and THOS. NOELL all the divident of land I now live on to be equally devided between them and their heirs for ever after my beloved Wife ELIZABETH decease.
I give and bequeath unto my beloved Wife ELIZABETH NOELL one third part of my Negroes and one third part of my personable Estate to her and her heirs forever.
ITEM I give unto my three sons and my two Daughter Viz. RICE, RUBIN and RICHARD, HESTER and MILLEY NOELL three parts of the rest of my negros and my parsonable Estate to be equally devided between them and theire heirs forever and the other part of my Estate I give unto my other six sons to be equally divided amoungst them and their heirs forever.
LASTLY I doe appoint and ordaine my beloved Wife my Executricks and my Two Sons JAMES and CORNELIUS NOELL Executors of this my Last will and Testament Witness whereof I sett my hand and Seale the words of the rest Interlined

At a Court held for Essex County at Tappa. on the 21st day of April 1741
This Last Will and Testament of JAMES NOELL deced was presented in Court by ELIZABETH NOELL Executrix and JAMES NOELL one of the Executors therein named who made oath thereto and being also proved by the Oaths of RICHARD ELLITT and CALEB ELLITT two of the witnesses thereto was admitted to record And then CORNELIUS NOELL the other Executor in the said Will named came into Court and relinquished his right of Executership thereto

KNOW ALL MEN by these presents that we ELIZABETH NOELL, JAMES NOELL, CORNELIUS NOELL & JOHN NOELL and WM. TAYLOR are held and firmly bound unto THOMAS WARING, JAMES GARNETT. ALEXANDER PARKER and JOSHUA FRY Gent Justices of the peace for the County of Essex in the sum of five hundred pounds Sterling Witness our hands and seals this 21st day of April 1741
THE CONDITION of this obligation is such that if the above bound ELIZA. NOELL & JAMES NOELL Executors of the Last Will and Testament of JAMES NOELL deced do make or cause to be made a true and perfect inventory of all the goods chattles and credits of the sd deced the same so made do exhibit or cause to be exhibited in the County Court of Essex at such time as they shall be thereunto required by the sd Court and further do make a just and true account of their actings and doing therein when thereunto required by the sd Court and also do well and truly pay & deliver all the Legacies contained & specified in the sd Testament as far as the goods chattles & credits will thereunto extend according to the value thereof & the Law shall charge them then this obligation to be void
