1928 Court proceedings seek to return Hermann Borst to Lowell

Contests Extradition: Lowell Man Fights Proceedings to Bring Him Here From Maine

A bitter fight is being made by Herman F Borst, formerly of this city, against extradition proceeding instituted by Lowell police and the district attorney's office seeking to get permission from Governor Ralph O Brewster to bring Borst to this state for arraignment on indictments charging him with desertion of his wife and minor children, and with being a fugitive from justice. Officer Patrick B Clark of the criminal investigation bureau, who went to Maine early this week, returned last night without Borst, but with an intimation from Governor Brewster that the extradition will be granted.

Borst was indicted by the Middlesex county grand jury, and with warrants issued by that body, Officer Clark went to Portland and picked up Borst. Later, Attorney Henry Sullivan of Portland, counsel for Borst, appeared with Officer Clark before Governor Brewster in the hearing on the petition for extradition.

During the hearing, Attorney Sullivan informed Judge Brewster that he has instituted proceedings in probate court in Maine for the custody of the children, but Officer Clark questioned him and learned that these proceedings were instituted after the return of the indictment by the grand jury at East Cambridge.

Attorney Sullivan requested that the matter be delayed for a few days, to allow him to confer with District Attorney Robert T Bushnell of this city, in an attempt to arrive at a settlement of the case without arraignment. The request was granted, and the matter is still held up. Officer Clark declared today that Governor Brewster indicated to him that the extradition will be granted if Attorney Sullivan and the district attorney do not reach a settlement.

The officer expects to return to Maine within a few days, to finish the case, and is hopeful that he will be able to bring back Borst.
