The Fort Wayne Journal Gazette (Fort Wayne, Indiana) > 1907 > January > 12 CASE DISMISSED SUIT COMMENCED BY THE OBER'S AGAINST HENRY WITT DISMISSED AT AUBURN Jan. 11,- Auburn Ind.,- The action commenced by the state on behalf of David and John Ober against Henry Witt which was set for hearing at ten o'clock today in Squire Walter's court was dismissed by the state and will probably be dropped, though it was intimated that an action would be filed in circuit court. It will be remembered that these men recently met in a fistic encounter, and in the affair, Witt was given the worst of it. Witt had been a tenant on the Ober farm and in the settlement or distribution of crops there had been trouble and this finally led up to the assult. It is claimed that the elder Ober knocked Witt down and then stood guard with a hatchet while his son jumped on him and for several days it was thought Witts injuries would prove fatal, though he is now able to be out. The Ober's at once filed the suit for assault, whicch was dismissed today. Witt has employed attorneys and with all probability commence a criminal action against the Ober's. At present neither of the Ober's can be located. -------------- ------------------ The Fort Wayne Journal Gazette (Fort Wayne, Indiana) > 1907 > January > 15 WANTS $5,000 DAMAGES - David and John Ober of Auburn ask to pay that sum for licking "Henry Witt" Jan. 14,- Auburn Ind. - Through his attorney J. E. Pomeroy Henry Witt this afternoon commenced action in circuit court against David Ober and his son John Ober, of this city asking damages of $5,000 for thee licking which the two men administered to Witt on December 4. It is alleged on that day in an angry manner David Ober knocked the p;aintiff down with a hatchet, hit him on the arm, ear and head, and while lying on the ground, John Ober with his fist and feet did abuse and injure him which caused him to be unconcious for several days and for all expenses incurred and other proper relIef he asked the court for damages in the sum of $5,000. -------------- ----------------------- The Fort Wayne Journal Gazette (Fort Wayne, Indiana) > 1907 > June > 5 GOT ONLY $100 IN DAMAGES - Result of a Holty contested Law-Suit that lasted for a week June 4,- Aubrun Ind.,- In the case of Henry Witt , against David Ober and John Ober, father and son of which damages of $5,000 were asked by the plaintiff for an assult on him by the defendants, the jury at 9 o'clock this morning returned a verdict of $100. for the Plaintiff after a deliberation which lasted a greater part of the night. The case is one which because of the prominence of the defendants, who are well known and wealthy farmers, atracted widespread attention, the courtroom being constantly crowded. It was begun in the circuit court before Judge Bratton and the jury just a week ago today. The final arguments were made Monday and the charge to jury was finished at 4 o'clock this afternoon. Whitt was the tenant on the farm of the Ober's. The tenantcy ceased last December and while Witt was endeavoring to move some of his belongings from the farm a quarrel ensued between him and the Ober's. It terminated into a fight and Witt was badly beaten by the Ober's. His injuries were for a time thought to be fatal. E.V.Harris of Fort Wayne, with J.E. Pomeroy, of this city were the attorneys for the plaintiff, and Howard W. Mountz of Garrett and Rose & Rose of the city for the defandants.
