Will Abstract
- Will of Daniel Mabry, Dec'd
- I Daniel Mabry of Rutherford County and State of Tennessee, being of disposing mind and memory do make and declare this to be my last will and testament hereby revoking and making void all other wills by me made at any time.
- First I direct that my funeral expenses and all my just debts be paid as soon after my death as possible.
- Secondly I give and bequeath to my two daughters Mary and Jane Mabry jointly all of my house hold and kitchen furniture all of my horses cattle hogs and stock of description and farm tools and wagon money and that may be coming to me at my death as also the tract of land in which I live at this time containing about eighty acres and also what was also I may possess at my death to be at their entire disposal and control.
- Lastly, I appoint my two daughters Mary and Jane Mabery Executrix to this my will and I do not require them to give any bond or security.
- Given under my hand and seal this 30th day of May 1861.

- The foregoing paper writing purporting to be the last will and testament of Daniel Mabry dec'd was this day May 7th 1883, presented in open Court for probate, and Wct. Reed, W D Kilbrough and Ed Arnold being duly sworn according to law, deposed and said that they were acquainted with James Kilbrough, one of the subscribing witnesses there to during his lifetime, and with his handwriting and they believe his signature them to be his genuine signature, and in his proper handwriting, __ the paper writing was ordered for further proof. And on this 12 day of May 1883 said papers writing was again presented in open Court for further proof, and John Woods and G.D. Fleming being duly sworn according to law deposed and said that they were acquainted with John Fleming one of the subscribing witnesses and they believe his signature there to be his genuine signature and in his own proper handwriting and is ordered to be recorded and filed.
