Will Transcript
- 5 Dec 1735: (p. 250) I, Benjamin Moss Sr. of the County of York of the Parish of Yorkhampton, being sick and weak of body, but of perfect mind and memory, do make this, my Will.
- First, my just debts are to be paid. (page 251)
- To my son, Edward Moss, all that plantation or parcel of land whereon my son, Benjamin, now lives, which I purchased of Robert Snead, containing about 50 acres. I also give Edward 60 acres more, part of the tract whereon I, myself, now live, which I desire may be laid off most contiguous and nearest adjoining to the other land next before given him.
- To my son, Francis Moss, all that lot of land in the Town of York, which I purchased of Abraham St. Leger.
- I desire that Francis may have full power to get as much timber, as framing, boards, and plank, off any part of my land as shall be thought sufficient to build him a dwelling house, shop, and to make him a garden (and no more) on the lot of land before given him. To my son, Benjamin Moss, the rest of my lands in York County or elsewhere.
- Since my son, Edward, is now young and incapable of managing the plantation I have given him,
- I desire that my son Francis (if he thinks fit) live on the sd plantation until Edward arrives to lawful age, he making no waste of timber but what is necessary for the better improvement of the sd plantation.
- To my son, Benjamin, my Negro man called Oliver.
- To my son, Francis, 3 Negroes named Emanuel, Ben, & Cate.
- To my son, John Moss, 5 Negroes named old Jack, Paul, Dina, Cane & Rachell.
- To my son, Edward, 5 negroes named John, Cutty, Judy, Pender, and Nanny.
- I desire that my son Benjamin, have the (page 252) care and tuition of my sons, John and Edward, until they arrive to full age, giving Benjamin full power to act for them during their infancy.
- To my son, Francis, being now about keeping house of his own, and being at present unprovided with stock for that purpose, 600 lbs of good, merchantable pork and 20 barrels of Indian corn.
- I want my just debts paid out of my personal estate in such manner as my Extor shall think bes, and whatever part remains unsold, as to be divided in 3 equal parts, 1 part going to my son John, and the other two thirds to be equally divided umong my other three sons, Benjamin, Francis, and Edward.
- I appoint my son, Benjamin, my Extor. I want my son-in-law, Mr. Henry Wythe, and my friend, Mr. Robert Armistead, to assist and advise my sd Extor, for the more exact and due performance of this, my Will.

- At Dec 15, 1735 Court, this will of Benjamin Moss, decd, was presented in Court by Benjamin Moss, the Extor, and being proved by the oath of Robert Armistead, Gent, and James Cook, 2 of the witnesses, who also declared that they saw Henry Wythe sign his name as a witness, it was OR.
