Benjamin Magee was a Civil War soldier. He enlisted at Camp Moore in June 1861 into Company I, 9th Louisiana Infantry, "Hays'" Brigade, as a Private. Angelina Magee, his widow, claimed in her widow's pension affidavit, that he was taken prisoner at the Battle of Gettysburg, and remained prisoner until paroled. However, service records showed that he was captured 7 Nov 1863 at Rappahanock; that he was confined at Point Lookout Maryland 10 Nov 1863, and that he was sent to City Point, Virginia 10 March 1864 for exchange. He was reported absent on muster roll dated 31 Aug 1864, and after that point as "deserted." The service records were reported in a Letter from the War Department 20 July 1903 to the Louisiana Board of Pension Commissioners, in the widow's pension file.
