Will of Barnabas Churchill

I Barnabas Churchill of Greene, Trumbull County, Ohio, do make and publish this my last will and testament.
Item 1st - I give and devise to my beloved wife Polly such goods and tenements as the proper authorities shall judge most suitable for her use during her natural life, to the amount of her legal dower. It is my wish that this dower be taken from such property as is by this instrument, afterwards bequeathed to Solomon S. Gunn & his wife Hannah Gunn.
Item 2d. I devise and bequeath, for the purpose of a Burying Ground, for the use of my relatives and such of my neighbors who wish to use it - as such. A piece of land upon the north side of my lot No. 24 in Greene, and to extend three rods west, and three rods east, from a cherry tree, and an oak tree growing together, which trees are a few feet east of the graves of three of my grandchildren, and to extend south from Mr. John Sloan's line, two rods, making twelve rods of land.A
Item 3d. I give and bequeath to my son Richard M., my two volumes of Systematic Theology by A.G. Finney. Also to my son Salmon R., Nelson on Infidelity, Morton's Apology. Also to my son Robert B., Mahan's Philosophy and D. Subigney's (?) History of the Reformation Vol. 6. Also to my daughter Sarah, one Bedstead, and bedding during her natural life. Also to my daughter Betsey Coats, my large Bible, after the decease of her mother. Also to my son Romeo one book, Universalism not of God.
Item 4th. I give to my son, Ira Rodney Churchill, my new Psalm Book. It is my wish that my son Ira R. should have a reasonable support during his natural life from the avails of the my farm, and the services of Solomon S. Gunn and his wife Hannah including his own labors, such reasonable support to include sickness, but not insanity, and his expenses to said Gunn, in no case to exceed $150 in any one year.
Item 5th. I give and bequeath to Solomon S. Gunn, and his wife Hannah, all the remainder of my real estate in the Township of Greene, (not including fourteen acres now under contract to said S.S. Gunn.) This estate contains about seventy-three acres of land. Also all my live stock, all my farming utensils and all carriages and Harness of every description. This item is upon the condition, that in case Ira R. Churchill should survive me, that Solomon S. Gunn, comply with my wish in the foregoing item by giving proper Bonds with security, for the faithful performance of said services during the natural life of the said Ira R.
Item 6th. It is my wish that my daughter Hannah Gunn, should have all my bedding and household furniture of every description, if any remains after the decease of my wife and Sarah Churchill and Ira R. Churchill.
Item 7th. The remainder of my property after paying my debts, if any should remain, it is my desire should be appropriated to the education of my granddaughter Ida Gunn, the acknowledged daughter of S.S. and Hannah Gunn. I wish her to have the benefit of an education at Oberlin, to extent of the above mentioned means, if practicable. Such practicability, or propriety to be judged of by her proper Trustee. In case of her death or any other disability - to this said Ida Gunn, this remainder I bequeath to Hannah Gunn.
Item 8th. It is my desire that Ami Leolin Hickok should be appointed Trustee to attend to the interests of Ira R. Churchill and Ida Gunn, agreeable to my wish in the foregoing items.
Item 9th. I hereby nominate and appoint Solomon S. Gunn, and Ami L. Hickok Executors of this my last will and testament, and I hereby revoke all former wills by me at any time made.

In testimony whereof, I have hereunto set my hand and seal this 27th day of December A.D. 1858.

A This Burying Ground is now known as Gunn Cemetery, where both Barnabas & Polly Churchill are buried.
