    Proceeding held before the Probate Court within and for
    the County of Preble and State of Ohio held in the Court
    House of Eaton O By the Honorable George W Gaus sitting sole Judge
    of said court on the 2nd day of December AD 1861
    Jacob Sayring and
    Isaac Bentley Plaintiffs
    Against In Probate Court
    Joseph Sayring Exor
    Of Adam Sayring dec'd
    Be it remembered that here-
    tofore ??? on the 8th day of November in the year of our
    Lord one thousand Eight hundred and sixty one then
    was filed in the office of the Probate Court one petition
    based in the words and figures following to wit: The
    above named plaintiffs say that the said Adam Sayring
    deceased, died in said County on or about the -- day of
    AD 1861 leaving Jacob Sayring, Elizabeth Bently wife of
    the said Isaac Bentley and Joseph Sayring as his only
    heirs and legal representatives, that soon after the death
    of said Adam Sayring the said Joseph Sayring presented
    in this Probate Court of said county what he claimed
    to be the last will and testament of the said Adam
    Sayring deceased and procured the same to be probated
    on the 30th day of April AD 1861 and took upon himself
    the trust of executor of said will, that at the time of
    said defendant took upon himself said trust he falsely
    and fraudulently represented to said court that the
    amount of personal property belonging to said estate
    which would come into his hands as such executor
    would not exceed the value of two hundred dollars and
    gave bond for the faithful discharge of his trust in
    the sum of Four Hundred dollars with William M
    Forible and George W. Foible as sureties in the service, when
    in fact the personal assets belonging to said Estate there
    in the hands of said Executor would amount to not
    less than two thousand dollars and which personal
    assets have never been accounted for by said executor.
    That since the said Joseph Sayring has accepted said
    Trust he has by deed conveyed his Real Estate to one
    John Shaffer who has conveyed the same to his wife of
    said Joseph Sayring for the purpose of placing the
    same out of the reach of persons interested in the faith-
    ful discharge of said trust. We the plaintiffs believe
    that a suit is now pending in the court of common
    pleas of Preble County to infer the specific performance
    of an agreement made by the heirs of the said Adam
    Sayring deceased concerning the settlement of said
    estate and the ??deossion?? of the assets of the same and
    that it may be of great importance to the plaintiffs
    that a bond for the full amount required by law be
    given by the said executor. Your petitioners therefore
    pray that a writ of citation may issue against
    the said Joseph Sayring Executor as aforesaid compelling
    him to show cause why said bond should not be
    increased so as to cover double the amount of assets
    in his hands as such. Executor Reamis and Abbott
    attorney for the plaintiffs, The State of Ohio, Preble County
    to the said Jacob Sayring being duly sworn says
    that he believes the statements of the foregoing petition
    to be true. Jacob S. Sayring aforesaid to such ??? before me

    In as much as ?? ?? which is the following ??? for summons.
    Issue a citation to the defendants in this action returnable on the
    22nd day of November AD 1861 for the defendant to appear
    and show cause why his bond as the executor of the estate of
    Adam Sayring deceased should not be increased and add
    additional security given on the same. To the Probate Judge of
    Preble County Ohio November 13th 1861. Reamis And Abbott
    Attorneys. And afterwards trust on the 13th day of November
    AD 1861 the following citation was issued out of said court
    To wit: The State of Ohio Preble county F. To the Sheriff of
    Preble County, Greeting: You are commanded that you summon
    Joseph Zehring to appear before the Judge of the Probate
    Court of said county at the court house in Eaton Ohio on
    the 22nd day of November 1861 at 10 O'clock am to answer
    a petition to show cause why his bond should not be increase-
    ed and additional security given exhibited against him by
    Jacob Zehring and Isaac Bentley. And this he shall in
    no wise omit under the penalty of one thousand dollars and
    have you then show this writ. Witness my hand and the
    seal of said court at Eaton this 13th day of November AD
    1861. George W. Gaus Probate Judge (seal) ???? upon which
    in the following ??? Personally by certified
    Copy on the 13th day of November 1861. J.R.MCliaf Sheriff
    and afterwards on the 2nd day of December in
    the year of our Lord one thousand Eight hundred
    and sixty-one this cause this day comes as to be heard
    upon the petition filed with the testimony of sort, iusses
    and being argued by counsel and the court being fully
    advised in the evidence find that there is not sufficient
    grounds to compel said executor to increase his bond.
    It is ordered and adjudged that said plaintiffs
    pay the said cost of this suit taxed $ and in default
    thereof that execution ??? for the ???? ?????
