The deposition of Joseph Morgan

taken at the tavern of George L. Waugh in the town of Harrodsburg, on the 18th of July 1826 agreeable to notice, to be read as evidence in a suit in the chancery now depending, and undetermined in the Mercer Circuit Court, which suit was originally brought in the name of Peter Casey against Nathaniel Randolph and Randolph filed his answer in the nature of a cross bill against Peter Casey and John Waggoner; and which suit has been recently revived in the name of the heirs of the said Nathaniel Randolph against Peter Casey and the unknown heirs of John Waggoner deceased.

Question by complainants. Do you or do you not [know crossed out and written above was the following word] believe that Malachi Randolph and Enoch Randolph were the reputed brothers of Nathaniel Randolph deceased?

Answer. I have always believed and understood that Malachi and Enoch Randolph were the brothers of Nathaniel Randolph and I have undertstood and believe that Enoch and Nathaniel Randolph are both dead.

Question by same. Did you or did you not know that Nathaniel Randolph never was married, and never had any legitimate children?

Answer. This was always my belief, I never heard of his having any family. And further this deponant saith not.

taken at the same time and place and to be read as evidence in the same suit.

Question by complainants. Do you or do you not believe that Enoch Randolph is dead?

Answer. I do believe he is dead.

Question by same. Will you be so good as to [mention?--vertion?] the names of the children of Enoch Randolph?

[Answer.] Anna, May, Malachi, Sarah, Nathaniel, Enoch, Rheuhamy, Samuel Hall and Martha: and Sarah is now married to a Mr. Glenn.

Question by same. Do you or do you not know that Nathaniel Randolph had any other brothers and sisters besides Malachi and Enoch?

Answer. I do not know. And further this deponent saith not.

This deponent has heard the deposition of Nathaniel Randolph Junr read, he concurs in the statements made by the sd Nathaniel and further this deponent saith.

The deposition of Ann P. Bridges

taken at the house of Walter Bohon in the County of Mercer agreeable to notice to be read as evidence in a suit in Chancery now pending in the Mercer Circuit Court wherein the heirs of Randolf are Complts and the heirs of Peter Casey are defts. This deponent being of lawfull age and duly sworn deposeth and saith That she was intimately acquainted with the family of Enoch Randolf

Question by complt-- Are or are not Malachiah and Enoch Randolf the reputed Brothers of Nathaniel Randolf

Answer-- They were always.

Quest by same-- Who were the children of Enoch Randolf, are or are not Mary Sarah Malachia Nathaniel Enoch Rohamia Hall.

Answer-- They are and I have also been informed that Enoch Randolf had another child named Martha and further this deponent saith not.

taken agreeable to notice at the same time place to be read in Mercer Circuit Court wherein the Heirs of Nathaniel Randolph are Complainants and the Heirs of Peter Casey are defendents. This deponent being of lawful age and duly sworn deposeth and saith

Question by complainant-- Are or are not Malichiah and Enoch Randolph the reputed brothers of Nathaniel Randolph

Answer-- I always believed and understood they were and further this deponent saith not.

This day Ann P. Bridges and Walter Bohon Subscribed their names & was sworn to within Depposition before me William Bohon a Justice of the Peace for the County aforesaid given under my hand this 3rd day of May 1828.

The Deposition of Elizabeth Randolph

taken at the law office of Daviess & Taylor in the Town of Harrodsberg agreeable to notice on the 15 Day of December 1842 to be read in Evidence in the Suit in Chancery now depending in the Mercer Circuit Court wherein the Heirs and Administrator of Nathaniel Randolph Decd are complts upon a Cross Bill filed by the said Nathaniel Randolph in his lifetime by way of Answer to a Bill in chancery exhibited against Said Randolph by Peter Casey Decd and Received in the name of Said Caseys Heirs and which sd Cross Bill is also Received against Said heirs & the heirs of John Waggoner, Decd

--This deponant being of lawful age and first duly sworn deposeth and Saith that She was well acquainted with Nathaniel Randolph for many years before his death, he lived to be an old Batchellor without ever marrying or having any child of his own

--that his only heirs are the children of his two Brothers Malachiah and Enoch Randolph both of whom are dead, leaving the following children (to wit) Malachiah Randolph, Mary Randolph, Sarah Glen, late Sarah Randolph, & David Glen, her husband, Nathaniel Randolph, Ruehamey Randolph, Enoch Randolph, Hall Randolph, children of Enoch Randolph, Decd, Clarkson E. Randolph, Malachiah Randolph, George Randolph, Elizabeth Randolph, Mary Green, late Mary Randolph, and Soloman Green, her Husband, children of Malachia Randolph, Decd, all of which Said Children constitute the heirs of Nathaniel Randolph, deceased, all of whom this Deponent is acquainted with and knows them to be children of the said Enoch and Malachiah Randolph and the ?expected? heirs of the Said Nathaniel Randolph, Decd

--upon further ?deliberation? this Deponant States that Some years ago She was acquainted with the children of Peter Casy, Decd and believe their

names are correct by Stated in the notice which She has heard read this day ^[interlinear: and attached to this Deposition] this Deponant does not recollect the year Nathaniel Randolph decd but thinks it must be at least twenty years ago--and further this Deponant Saith not

The Deposition of Benjamin C. Trapnall

taken at the Same time and place to be read in Evidence in the Suit aforesaid

--This Deponant being of lawfull age and first Sworn deposeth and Saith that Samuel Casy, Nicholas Casy, John Casy, Fanney Finney, and Philip Trapnall and Nancy, his wife, are the heirs of Peter Casy, Decd and further this deponant Saith not.
