He left everything to his wife, Mary Peterson, and appointed her to act as independent executrix without bond. Their home was on Lot 10 in Block 2 of Alamo Gardens Addition to the City of Waco. He and his wife owed to their son, Billy G. Peterson and his wife, Mary Lou Peterson, $500 for the purchase price of this home. They had not given a note to their son to secure this debt. The deed from Billy G. Peterson to Will and Mary Peterson, conveying to them this home, was dated 4 June 1956 and recorded in Volume 786, page 611 of McLennan County Deed Records. This debt, if it was still owing at the time of Will's death, should be paid from cash or some other asset of Will's estate should be sold to pay this debt. If Will's wife, Mary, predeceased him, everything should go to his seven children in equal shares, after payment of that $500 debt to Billy G. Peterson and wife, Mary Lou. The children were:

Ettie Cleo Peterson Dvoracek, daughter, wife of Bennie Dvoracek 6. Louise Peterson Horn, daughter, wife of Harvey W. Horn 7. Billy G. Peterson, son If his wife was deceased or unwilling or unable to act as independent executrix, he named Billy G. Peterson as independent executor. He wanted his lawyer, A. D. Mabray to probate his will.

On 28 May 1964, Mary Peterson Taylor, of 1410 North 13th Street in Waco, filed the will for probate. She said Will died in Waco on 14 January 1963 in Waco at age 76. His assets were his interest in their home at 1410 North 13th St. and personal property. She was his widow, now known as Mary Peterson Taylor. She was married and now age 72. The attorney for the estate was Alton B. Clark of Waco. On 11 June 1964, Mrs. Ann Hooks, who was formerly Mrs. Ann Howard, signed an affidavit that stated she and Jack N. Price were the witnesses to the will. Jack N. Price then lived in Austin. Inventory of the estate was filed 15 June 1964 and was recorded in Volume 245, page 411 of Probate Minutes and was approved the same day.
