Heisterkamp's Annotated Landis Ferree Tree (as of 30 April 2004)

This Indenture Made the twenty third day of August in the Year of our Lord one thousand and seven hundred and fifty eight Between Solomon Ferree of Sadsbury Township in the County of Lancaster & Province of Pennsylvania Yeom. & Rebecca his wife on the one part and John Rees of Strasburg Township in ye County & Province aforesd. Yeom. of the other part Witnesseth that the said Solomon Ferree and Rebecca his wife for & in Consideration of the Sum of five hundred pounds Currant money of Pennsylvania to them in hand well & truly paid by ye sd. John Reece whereof is hereby acknowledged they the sd. Solomon Ferree & Rebecca his wife Have and each of them Hath given granted aliened enfeoffed released and confirmed and by these presents Do and each of them Doth fully freely and absolutely give grant alien enfeoff release and confirm unto the sd. Jno. Rees his Heirs and Assigns, all that Piece or Parcel of Land situate lying and being in Strasburg Township aforesd. Beginning at a white oak Tree thence extending by that part allotted to the sd. Solomon Ferree East Seventy seven perches to a post thence by John Ferrees Land South by East two hundred & seventeen perches to a Post thence by the same West seventy seven perches to a post thence by Danl. Ferrees Land north by west two hundred & seventeen perches to ye place of Beginning containing ninety five acres & five perches and allowance of six percent for Roads & Highways, being a certain Tract granted by Moses Ferree & Esther his wife unto the aforesd. Solomon Ferree his Heirs and Assigns for ever as by their Indenture bearing date the twenty sixth day of June in the Year of our Lord one thousand seven hundred & fifty five and entered in the Office for recording of Deeds for the County of Lancaster in Book D. Page 343 & relation thereunto being had may more fully & at large appear Together with all and singular the Improvements ways woods waters water courses Rights Liberties Priviledges Hereditamts. and appurtenances whatsoever to the sd. peice of Land and Premises hereby granted or intended to be, belonging or in anywise appurtaining and all the Estate Right Title Interest Property Claim and Demand whatsoever of them the sd. Solomon Ferree and Rebecca his wife of in to or out of the same and the Revertion and remainders rents issues and Profits thereof and all Deeds or true copys of Deeds Evidences and writings touching or in anywise concerning the same to be had and taken at the proper l(ost?) and Charge of the sd. Jno. Rees his Heirs or Assigns To have & to hold the sd. peice or parcel of Land hereby given and granted or mentioned or intended so to be, & every part or parcel thereof with ye. appurtenances unto the sd. Jno. Rees his Heirs Assigns to the only proper use of the said Jno. Rees his Heirs & assigns for ever. Subject nevertheless to the proportionable part of the yearly Quit rent due to the Lord or Lords of the fee thereof And the said Solomon Ferree and Rebecca his wife for themselves their Heirs Executors and admrs. doth Covenant promise grant and agree to and with the said John Reece his Heirs and Assigns that they the said Solomon Ferree and Rebecca his wife and their Heirs and every other Person or Persons whatsoever now having or lawfully claiming or hereafter to have or lawfully claim any Estate right title or Interest whatsoever of in or to the sd. hereby granted Trust of Land Hereditaments and Premises with the Appurtenances or any part thereof by from or under then or either of them shall & will at anytime or times hereafter at the request Cost and Charges of the sd. Jno. Rees his Heirs and Assigns make do acknowledge l(eve?)y suffer perfect and execute or cause and procure so to be, all & every such further and other lawful and reasonable act and acts Deed and Deeds Thing and Things Conveyance and Assurance in the Law whatsoever be it by fine feoffmt. Common recovery or otherwise for the further better more sure perfect and absolute granting conveying assuring releasing and confirming all and singular the said Premises with ye appurtenances or any part thereof unto the sd. Jno Rees his Heirs and Assigns forever as by him or them or his or their Council learned in the Law shall be reasonably advised or devised and required In Witness whereof the sd. parties to these presents their Hands & Seals have hereunto interchangeably set the Day and Year first above written.

Rec. the day and year first above written of and from the above named John Rees the sum of five hundred pounds it being the full Consideration money above mentioned to be paid to me. Solomon Ferree, Witness The 23 day of August 1758 before me the Subscriber one of his majesties Justices of the peace for the County of Lancaster came the above named Solomon Ferree and Rebecca his wife & acknowledged the above written Indenture to be their act and Deed and desired that the same may be recorded as such the Said Rebecca thereto voluntaryly consenting, She being of lawfll age and secretly and apart examined the above Contents being first made known unto her Witness my Hand & Seal Thos. Holliday (seal)
