Footprints Along The Hoopee A History of Emanuel County 1812 - 1900 James E. Dorsey Page 83 RK0006 Transcribed by William Knight One other slave was brought to trial in the 1850's. Identified only as "George," he was charged with "assaulting a free white person with intend to murder." The original indictment was quashed, but a new one was later filed. The jury found him guilty, but did recommend mercy. He was sentenced to serve a term of six months in the Emanuel County jail. While there, he was to be given 50 lashes with a whip per week. At the end of his sentence he would be branded with the letter "M" on his right cheek and then be delivered to his owner, Rufus Knight. The sentence was harsh by today's standard, but his offense-attacking a white person-could be a capital crime. In this sense he was lucky to fare as well as he did. Another element in George's "light' sentence was the fact that slaves were valuable items of property. If a slave were killed, his owner would suffer a definite material loss. By imposing a tough sentence-yet one short of death-the court could punish the offender and still protect the owner's invenstment.

George A Negro Man Slave September 26, 1856 Prisoner arrained and the following sentence passed Where upon it is considered and adjudged by the court that you George be taken hence to the common jail of Emanuel County and there confined for and during the space of six months, that you do recieve during that time, on each Tuesday during said imprisonment between the hours of ten and twelve in the morning fifty lashes on your bare back to be infliated by the sheriff of said county or his deputy at the door of the jail; that at the expiration of said six months you be branded on your right cheek with the letter M, and then delivered to your owner Rufus Knight, and it is further considered and ajudged that the said Rufus Knight your owner do pay all costs and expenses attending your prosecution, conviction and punishment.

Gaddy - Rufus Knight - C.R. Tondee - W.A. Prevatt To Clem Powers Know all men by these presents that we William Gaddy, Rufus Knight, Charles R. Tondee and William A. Prevatt, all of the county and state aforesaid for and in consideration of the sum of Three Hundred and Fifty One Dollars and Fifty Cents, to us in hand paid by Clem Powers of the County of Effingham and state aforesaid, and before the sealing and delivery of these presents the receipt where is hereby acknowledged have bargained and sold and of these presents so bargain and sell to the said Clem Powers his heirs and assigns, two negroe or mulato girl slaves the one called Mariah (alias Mary) about eight years of age and the other her sister about six years of age called Lucy with the future increase of their or either of their bodies. To have and to hold said bargained property to him the said Clem Powers his heirs and assigns forever. And we the said William Gaddy, Rufus Knight, Charles R. Tondee and William A. Prevatt for ourselves our heirs executors and Administrators all and singular the said bargained property unto the said Clem Powers, his heirs and assign against us and our heirs and against all and every other person and persons whatever shall and will warrant and defend by these presents. Emanuel County Probate Court Minutes of Superior Court 1854 - 1860 RK0015 October Term 1854 The Grand Jury selected and sworn and empaneled to serve at the present term of the court make the following presentments to wit we find our jail in good order and neatly kept, we find no necessity for leving any additional tax for the ensueing year, we further consider our roads in good order and our bridges (likewise) also as far as our knowledge extends we have further proceeded to make out a list of poor children and have returned the same to the ordinary of said county. We have no further presentments to make further than this body presents their thanks to his honor the judge of said court for his most kind and cordial treatment to them during the present term to the states attorney.     Will be sold before the Court-house door in the town of Swainsboro, Emanuel County, on the first Tuesday in June next, within the legal hours of sale the following property to-wit:

    Two tracts of pine land, on containing 700 acres more or less lying on Bakers Branch, adjoining Millers and others. One other tract containing 286 acres more or less, adjoining lands of David Griffin and others, all levied on as the property of Charles McColloughs, to satisfy three Superior Court fi fas in favor of Rufus Knight and others, vs. Charles McColloughs. Property pointed out by defendant.

    Also at the same time and place, will be sold 100 acres of pine land more or less, lying on the Big Ohoopie river, and ajoining Charles McCollough and others, levied on and the property of David Griffin, to satisfy on Superior Court fi fa in favor of the officers of the Court, vs. David Griffin.     Also at the same time and place, will be sold 250 acres of pine land, more or less, lying on the Ohoopie river, adjoining lands of Anthony Phillips, and others, with improvement, thereon, levied on the property of Thomas Smith, to satisfy two Superior Court fi fas, in favor of William Hail and others, vs. Thomas Smith. Met in persuance to adjourment 1st on motion of Mr. Richard Edenfield, It is ordered that all persons indetted to the Common School of Instruction pay up the interest due and fifty percent on the principal, also it's furthered ordered that Clarence (?)    Sorry I did not get back to you sooner,  it is the flu not a cold.  Anyway, I have at the top of the document that it was from Emanuel Co. Will Book A&B  1815-1907.  I spoke to my sister tonight and she said she does not remember ever checking Emanuel Co.  but that is what is in her handwriting.  She is going to check tomorrow,  her copy of Effingham Co., Georgia Annals which has quite a few Knights listed in that. 
  Let me ask you if these names sound familiar to you in your searching.  I have a copy of a deed from Deed Book L page 490 Effingham Co., Ga. but the entry states Chatham Co.,
W. Gaddy, Rufus Knight, C.R. Tondee & W.A. Prevatt to Clem Powers  for two negores or Mulato girls the one called Mariah (alias Mary) about eight years of age and the other her sister about six years of age called Lucy 

C.R. Tondee was my 3th Great Grand father, I believe William Prevatte married Sarah Gaddy, daughter of Martha Gaddy Hollinger Speirs and This W. Gaddy could have been Sarah's brother, Martha's son.  I have a tremendous amount of information on some of these lines, but I have not been working genealogy for some time,  I am presently working on a History of a Georgia Regiment from the Civil War.  So I put my genealogy on a back burner about 7 yrs ago, but still try to keep it active thru the mail list, just to have some memory when I get back to it if I ever get the book published.

Do you know the Knights were in Edgefield Co., S.C. at one time? At least I believe I saw something earlier today when going through my files. I do know several of my family surnames were there and traveled down into Georgia together. I apologize for being so sketchy, but this flu really has me empty headed.

When I am feeling better I will try to get together some info to send you. You mentioned you search the Emanuel Co. records, did you search the Effingham, Chatham Co. and Richmond Co, (Augusta, Ga.) That was the travel pattern they followed from S.C.
