Will of Rowland Emree

In the name of God, amen. I Rowland Emree, of the town of Ohio, in the county of Herkimer, and State of New York, Being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last will and testament.

I give and bequeath to my sons John and William my land which is one hundred and fifty acres and each to have one half and that William shal live with John or have a holme their till he shall become of age and that said William shall have his school___ and all necessary clothing while he remains with John. I give and bequeath to my beloved wife Hannah one horse, one horsewagon, _____ and her third one third of all my personal property and the two thirds to be divided equily among my girls.

I do nominate and appoint Marcus Hemstreet to be the sole administrator of this my last will and testament.

In testamony where of I hereunto set my hand and seal and publish and decree this to be my last will and testament in presence of the witnesses named below, this fifteenth day of November in the year of our Lord, One Thousand Eight Hundred and forty nine.

To the Surrogate of the County of Herkimer:
The Portion of Marcus Hemstreet of the town of Ohio in the county of Herkimer, respectfully represents, That your petitioner is an acquaintance of Rowland Emree late of the town of Ohio in the couty of Herkimer, deceased, and is the Executor named in the last will and testament of said deceased, thich is herewith presented to the Surrogate, and which your petitioner received from the testator in his life time at the time of its execution and your petitioner prays that such proceedings may be had thereon, that the same may be admitted to probate as a will of personal property, and may be proved and recorded as a will of real property. And your petitioner further represents that the said Rowland Emree died at his own residence in the town of Ohio in the county of Herkimer, on or about the fifteenth day of December 1849 leaving real and personal property in the county of Herkimer, and leaving a widow, Hannah Emree who resides in the county of herkimer, town of Ohio and the following children to wit, Serina Hollenbeck, the wife of Cornelius Hollenbeck aho resides in Constantia, Oneida County, Margaret Ann Hallenbek the wife of Francis Hallenbek who resides in Fairfield, Herkimer County, Elisa Kittle the wife of Thomas Kittle, John Emree, Gitty Maria Emree and William Emree, Lydia Williams, the wife of John Williams who reside in Ohio Herkimer County, NY and that the above named persons are all and the only heirs at low of said Rowland Emree, deceased, to the best of his knowledge, information and belief.
