Notes, Probate Record Book, Clinton County, Indiana, Vol. 1, 1833-1846; LDS #2259823 p. 97-120 – Estate of Roland Lindsay 21 June 1832 Letters of Administration granted to James A. Maxwell. Based on inventory, Roland Lindsay was a merchant. No evidence of obvious members of family as buyers in estate sale. Lindsay had many debts, inc. to Isaac Claypool, Samuel Mitchell, Henry and Solomon Young. On 11 Feb 1834 and following, David Matlock Adm of Estate of James Matlock for use of James Irwin claimed much of store stock was debt owed to James Matlock. James Maxwell Administrator of Roland Lindsay estate counter claimed that stock was a gift given in consideration of natural love and affection of Lindsay’s father-in-law James Matlock between [blank date] and 21 Jan 1832 12 May 1834 – David Matlock countered and added that James Matlock had supported Lindsay for 3-4 years after his marriage [Nov 1828]. Case went to trial May 1834, with evidence for Plaintiff given by W. W. Matlock, son of James. Jury found for David Matlock. James Maxwell Appealed in May Term 1834, with John Dunn providing surety bond. In Feb Term 1836 Circuit Court found for Appellant (James Maxwell) as evidence of W. W. Matlock in trial was in error. Appellee (David Matlock) to pay costs. [i.e., transcription (LDS #977.2553 P286) in error, has decision reversed] August Term 1836 – Administration of Probate of Estate of Roland Lindsay completed, with additional payment to Administrator for costs of resisting claim of John Irwin on estate. [i.e., David Matlock did not pay costs as ordered by court, but John Irwin did not get funds from Lindsay’s estate] References
