Thumbnail Sketches, deaths, and obits extracted from Moffitt Book Vol. III TYPHOID FEVER

Three deaths from typhoid fever in the Summer-Hale area were reported in the _____ of January 19, 1865. One of the victims was John Acheson, supervisor from Sumner township, and the others Robert K. Mitchell, of near Sugar Tree Grove, in Hale township and Miss Louise Nash of the same township.

LAST WILL AND TESTAMENT OF ROBERT K. MITCHELLI, Robert K. Mitchell, of the Town of Hale in the County of Warren State of Illinois do hereby make and declare this my last Will and Testament in manner and form following to wit:

First. It is my will that my funeral expenses and all my just debts be fully paid.

Second. After the payment of such funeral expenses and all justdebts I give, devise, and bequeath unto my beloved wife Permelia Mitchell the South part of the farm on which we now reside, and all appertaining not otherwise disposed of. Situated in said county, and known and des-cribed as the West 1/2 of the North East Three (3) Eleven (11) NorthThree (3) west, containing 77 acres more or less. Also the privileg eof all the firewood she needs for fuel and c of the West 1/2 of the NW twenty two (22) Twelve (12) North. Three (3) West containing 20 acres during her natural ife, and one horse of her choice. Two head cows and calves, Ten (10) sheep, Ten (10) hogs, her choice of all I have on hand at the time. Also all the household furniture including stoves, beds, bedding,and all other articles of household and kitchen furniture except a bed and bedding for each of my 2 sons, W. A. Mitchell and J. P. Mitchell during her natural life. And at her death all the property aforesaid(except the land) to be bequeathed or so much thereof as may remain unexpended to be sold and the proceeds divided between my 4 children and their heirs. Except the beds and bedding my wife brought with her is to be divided between her nephew J. M. Cook and Susannah Jamison if living and the 8 day clock to be given to J. M. Cook.

Third. I give and bequeath unto my son Wm. A. Mitchell the North part of the farm I live on. Described as follows: The south 1/2 SEThirty four (34) Twelve (12) North. Three (3) West containing 80 acresmore or less. Also the West 1/2 NW SE Twenty Two (22) Twelve (12) North Three(3) West 20 acres more or less except what I reserved to my wife. Also to have use of 1/2 the Barn and 1/2 the orchard during my wifes natural life. And the balance of all the stock and farming utensils on the farm not otherwise disposed of after paying all my funeral expenses and just debts. The said Wm. A. Mitchell to provide clothing and schooling and take care of J. P. Mitchell till he arrives at maturity.

Fourth. At my wifes natural death the whole of the farm described above I give, devise, and bequeath to my son, W. A. Mitchell, his heirs, Executors, and assigns forever. In consideration of which the sai dW. A. Mitchell agrees to relinquish the payment of money due him from me and to pay to my daughters Margaret J. Wilson and Manerva T. Young(or their heirs) each five (5) hundred dollars in addition to what I have given them in the manner following at least one hundred dollars to each of them yearly till they are paid. The said W. A. Mitchell further agrees to pay to my son J. P. Mitchell his heirs or assigns the sum of One thousand (1 ,000) dollars in the way and manner following to wit: when my son J.P. Mitchell arrives at the age of 21 the said Win. A. Mitchell is to pay the full sum of 1,000 dollars and also to furnish the said J. P .Mitchell a reasonably good horse. Except so much as J.P. may use in board if he should go to college, the said W. A. Mitchell is to board, clothe,and furnish books for the said J.P. Mitchell except what time he attends college his board is taken from the 1,000 dollars. If J. P. Mitchel lwishes to go to college and make himself a scholar he is to have the use of my scholarships for that purpose and the balance to W. A. Mitchell.

And, lastly, I hereby constitute and appoint my wife Permelia Mitchell and my son Wm. A. Mitchell executors of this my Last Will and Testament revoking and annulling all former wills by me _________and ratifying and confirming this and no other to be my Last Will and Testament.In witness thereof I the said Robert K. Mitchell have hereunto set my hand and seal at this first day of March in the year of our Lord One Thousand Eight Hundred and Sixty Four.

Signed, sealed, published, and declared by the said Robert K. Mitchell as, and for his Last Will and Testament in the presence of us who in his presence and in the presence of each other and at his request have subscribed names as hereto

Robert K. married Mrs. Mary C. Shoemaker, Dec. 21, 1854 in Warren County, IL. Mary C. (Shoemaker) Mitchell died 186__, buried in Cedar Creek Cemetery, Sumner Twp., Warren Co., IL

Robert died 5 January 1865 at 56 years, 1 month, and 29 days. He is buried next to William in the Monmouth cemetery.
