    Deed for lot No 3 containing 19 ½ acres of land Taylor Co

    This deed made this 1st day of April 1862 before Spencer Dayton, Commissioner, of the one part and Mary E. Johnston, Rebecca V. Johnston and William H Johnston heirs at law of Robert P. Johnston deceased of the other part whereforth.

    That whereas a suit in chancery was instituted and is now pending in the Circuit Court of Taylor Co in the state of Virginia in the ( ) of Abraham Johnston vs Abraham Johnston heirs () to procure a petition and allotment among the parties in interest of certain lands in the record of the said suit more particularly described and set forth and such surroundings were had ( ) that at the Spring Term 1862 of said comt a ( ) of petition was rendered and the said Spencer Dayton’s appointed a commissioner to convey the respective parties in interest crtain parcels of the said land by meters and bounds as in the said decree is directed ( ) being ( ) in these recitals.

    Now in consideration thereof and for the sum of one dollar in hand paid to the said Sencer Dayton the receipt of which is hereby acknowledged the said Spencer Dayton commissioner as aforesaid doth grant to the said Mary E. Johnston, Rebecca V. Johnston, and William H. Johnston at law of Robert P. Johnston all of that certain piece of parcel of land lying and being in the said county and in the plat and proceedings of the said suit mentioned and described being the lot No. 3 named therein and bounded as follows ( ): Beginning at w stake () 81 ⁰ W 12 poles to a stake then as A 15 ⁰ E of poles to a stake on a line of lot No 5 then co S 81 E (…) to the beginning containing by actual survey make in the said case 19 ½ acres to the same (…).

    To have and to hold the said piece or parcel of land to them the said Mary E. Johnston, Rebecca V. Johnston and William H. Johnston Heirs at law of Robert P. Johnston deceased and to their heirs and assignees forever.

    Witness the following signature and seal of the said Spencer Dayton, Commissioner in aforesaid and () annexed the day and year first herein above written.
