IN THE MATTER OF THE ESTATE OF MARTHA TEMPERANCE RAWSON, Deceased.
P E T I T I O N
To the Honorable R. C. Stanford, Judge of said Court:
Comes now William B. Rawson and respectfully represents and petitions as follows: that he is and has been for many years last past a resident of Maricopa County, State of Arizona.
That on the 18th day of Dec. 1903 your petitioner was married to the said Martha Temperance Rawson, which occurred at Mesa, Arizona, on the 28th day of September, 1914; that the father and mother of said Martha Temperance Rawson are dead, and that the said Martha Temperance Rawson left no children or other issue her surviving, and died intestate:
That your petitioner and the said Martha Temperance Rawson, during such marriage acquired on the 19th day of September 1914, the following described real estate, situated in the County of Maricopa, State of Arizona:
The West half (W1/2) of the Northwest Quarter (NW ¼) of the Southeast Quarter (SE ¼), excepting thirty-three (33) feet on the North Line for road purposes, of Section Thirty-one (31), Township One (1) South, Range Five (5) East, of the Gila and Salt River Base and Meridian, containing Twenty (20) acres, more or less. Together with all rights and privileges appurtenant or to become appurtenant to said lands by virtue of the subscription for Twenty (20) shares of the Capital Stock of the Salt River Valley Water Users Association, and subject to all the terms, conditions and liabilities incident thereto.
That all of the above described property was acquired by your petitioner and the said Martha Temperance Rawson, as community property of your petitioner and the said Martha Temperance Rawson, and so remained from the said date of its acquisition until the time of her death;
That the said Martha Temperance Rawson left no property at her death except her community interest in the property above described, and that under the laws of the State of Arizona, the said property passed to and vested in your petitioner, and he is entitled to have an order made by this Court without any formal administration of the estate of said deceased, setting aside to, and vesting said property in your petitioner.
WHEREFORE your petitioner prays an order be made by this Court directing the Clerk thereof to give notice as may be required in said order, of the hearing of this petition, and requiring all persons interested in said estate to appear and show cause, at said hearing, if any they can have or may have, why the prayer of your petitioner should not be granted, and that after such notice is given, and upon the hearing of this petition this Court make an order decree setting aside to and vesting the above described property in your petioner.
