    Before 1820, he migrated with his family from Delaware to Pickaway County, Ohio. Between January & July 1823, he migrated to Fountain County. On 4 Aug 1823, he entered W 1/2 of SW 1/4 of Section 14 & E 1/2 of SE 1/4 of Section 15. In 1824, he returned briefly to his family in Pickaway County, then returned and became a permanent resident of the township. Between Aug 1826 & Sep 1830, he served as one of two associate judges with a (nonresident) senior judge. "Judge Nebeker" built his cabin in Nov or Dec 1827. Judge Joseph Ristine calls him the "old chief of the family," at which time he had 3 sons & 2 daughters at home, including Richard, George, and Lucas.

    "Former residences of some early residents of Fountain County, based on U.S. land patents recorded in deed records": He reportedly lived in Wabash County, Indiana, in 1825 and in Pickaway County, Ohio, in 1826 (but see Beckwith).

    Lucas Nebeker's Last Will.

    In the name God, Amen. I Lucas Nebeker, of Fountain County, Indiana, farmer, being weak in body but of Sound mind and memory, blessed be Almighty God for the Same, do make & publish this my last Will & Testament in manner and form following---

    First, I Give and bequeath to my beloved wife, Hannah Nebeker, the one Sixth part of all the profits of the cultivated land now under cultivation together with the Mansion house & barn Garden & firewood and also as much of my personal property as She may Select.

    Second, I also give and devise unto my Son, John Nebeker, his heirs and assigns, all that lot of land being the west half of the S.W. quarter of Section 14 T. 20 North of Range 9 West, also one half of an undivided lot of land be the West Fraction of the South west quarter of Section Seven Township twenty North of Range Eight West to hold to him, his heirs & assigns forever, by paying the Sum of Five hundred & Sixty three dollars to my Estate as will be mentioned hereafter.

    Third, I Give and devise to my Son, Richard M. Nebeker, his heirs & assigns, all that lot of landbeing the West Fraction of the North West quarter of Section 12 T. 20 North of Range nine West, and also the North East Fraction of Section 11 T. 20 North of Range 9 West, to hold to him, his heirs & assigns forever, by paying the Sum of Seven hundred and thirteen dollars to my Estate as will be mentioned hereafter.

    Fourth, I Give and devise unto my Son, George Nebeker, his heirs and assigns, all that lot of land being being [sic] the East half of the South East quarter of Section 15 Township 20 North of Range 9, also that lot of land being the East Fraction of the North West quarter of Section 12 Township 20 North of Range 9 West, by paying the Sum of Nine Hundred and thirteen dollars to my Estate as will be mentioned hereafter.

    Fifth, I Give and devise to my Son, Lucas Nebeker, his heirs and Assigns, all that lot of land being the East half of the South West quarter of Section 12 Township 20 North of Range 9 West, by paying the Sum of Nine Hundred & thirteen dollars to my Estate as will be mentioned hereafter.

    Sixth, I Give and bequeath to my Daughter, Nancy Adamsom, her heirs and Assigns, Eight Hundred and Eighty Six dollars to be paid as follows. My Son, John Nebeker, to pay five Hundred and Sixty three dollars, to be paid in two Equal Enstallments, the first payment in one year after my decease, the Second in one Year After. Also three Hundred & twenty three [dollars] by my Son, Richard M. Nebeker, to be paid in two Equal Enstallments, the first payment in two years after my decease, the Other in one Year After.

    Seventh, I Give & bequeath unto my daughter, Hannah Nebeker, her heirs and Assigns, the Sum of Eight Hundred and Eighty Six Dollars to be paid by my Son, Richard M. Nebeker, to be paid in two Equal Enstallments, the first to be paid one Year after my decease, the Second in three years After, also four Hundred and ninety Six Dollars to be paid by my son, George Nebeker, in three Equal Instalments, the first in one Year after my decease, the Second in one year after, the third in two Years after.

    Eight[h],I give and bequeath to my Daughter, Mary Nebeker, her heirs & Assigns, the Sum of Eight hundred & Eighty Six dollars to be paid as follows, Four Hundred and Seventeen dollars to be paid by my Son, George Nebeker, in four Equal Enstallments, the first in four Years after my decease, the Second in one Year, third in two years, the fourth in three Years after the first. Also four hundred and Sixty nine dollars to be paid by my son, Lucas Nebeker, in Six Equal Enstallments, the first in One Year after my decease, the Second in two years & so one, making the Sixth the Sixth Year after my decease.

    Ninth, I give & bequeath to my Grand Son, Lucas McKinney, four hundred and forty three Dollars to be paid by my Son, Lucas Nebeker, when the said Lucas McKinney Shall arrive at twenty one Years of Age, if he should not live to that age the Aforementioned Sum of Four Hundred and forty three dollars to be Equally divided Amongst my heirs then living.

    And Lastly, all my personal property Excepting what my wife takes to be Sold and Equally divided Amongst my Sons & Daughters then living, and hereby I do appoint my Son, John Nebeker, my Sole Executor of this my last Will and Testament. In witness whereof I have hereunto Set my hand and Seal the twenty ninth day of March in the Year of our Lord one thousand Eight hundred and thirty Seven.

    This day personally Appeared before me the Undersigned Clerk of the Court of Said County, George Nebeker, one of the Subscribing witnesses to the Above & forgoing will who being by me duly Sworn deposeth & Saith that he Saw Lucas Nebeker, the Testator aforesaid, Sign, Seal, Publish and Declare the above & foregoing as and for his last Will and Testament and that he believes he was of Sound Mind & Memory at the time of its Execution and that he Signed his name as a Witness thereto in his presence & at his request.

    In witness whereof I have hereunto Set my hand and the Seal of Said Court this twentieth day of September A.D. 1839
