    Hopkins County, Kentucky Court

    I Joseph Loving of the County and state aforesaid knowing that it is appointed unto all men once to die & being now in my sound and perfect mind with my own full consent & freedom of will do make and ordain this as my last Will and Testament in manner and form following to wit,

    First, The debts that I now owe and the expenses that I may incur during the time that I may live must be paid out of what is owing to me or from a sale of my estate.

    Secondly, I give and bequeath to my beloved wife Mary or Polly Loving a certain negro girl or woman named Hannah to keep for her own use & benefit for and during her natural life then the said girl Hannah & her increase shall revert to my legal Devisees or Heirs as expressed in this Will, but if my said wife Mary should marry again then her and her husband shall give security for the safe keeping & return of the said property to my Heirs as aforesaid at the expiration of her natural life as aforesaid.

    Thirdly, I give and bequeath to my two grandsons ***[family, finally, formally?], Joseph C. & Baylis B. Loving who are the sons of my son Wm Loving a certain negro woman named Mary and her child America and all the profits or money arising from the hire of said negroes to go to the schooling of said Joseph and Baylis.

    Fourthly, I give to my son Oliver Loving a certain negro girl called Nancy that he now has in possession.

    Fifthly, I give to my son James Loving a certain negro girl named Hester.

    Sixthly, I give to my son Prior Loving a certain negro boy named Henry.

    Seventhly, I give and bequeath to my daughter Louisa Loving a certain negroe girl called Delilah.

    Eightly I give to my daughter Da**da Miller, the wife of Felix Miller and her Heirs that are the increase of her own body a certain negro woman Mary that is the oldest woman that I now own.

    Ninthly I give and bequeath to my grand children Parmela, James, Susan, Joseph, Martha, Mary Jane, Da**da & Wm Henry Littlepage the present Heirs of my daughter Eveline Littlepage and all other children or Heirs of her own body that the said Eveline may bear a certain negroe child (of Mary's) that now sucks by the name of Ann Mana & as I once gave to Ellis Littlepage the husband of said Eveline very near an equal portion with what I have now given to my other Heirs and as I now give this child to her children I do consider all dealings between him & myself as fully settled.

    Tenthly I give and bequeath to my son John Loving in addition to what I have heretofore given to him and now hold his note for a certain negro boy named Charles.

    Eleventh I give to my daughter Jane Elizabeth Loving a certain negroe girl named Rachel.

    Twelfthly, I do hereby constitute and appoint my son Prior Loving & my wife Mary Loving as my Executors of this my last Will and Testament.

    Thirteenth I leave to my Executors a certain negro boy named Lewis for them to keep on the farm or to hire out as the situation necessity or comfort of the family that I now leave behind may require and when the youngest child shall die, marry or attain to lawfull age said Boy Lewis shall be sold and the money divided between my Heirs as aforesaid.

    Fourteenth, My Executors shall use all necessary exertions to collect the money or debt that may be due to me and after selling all the perishable property that I possess and paying the debts that I owe then divide the ballance between my said wife Mary and the sons of Wm. Loving dec'd and my own children as named in this my last Will.

    In testimoney whereof I have hereunto set my hand and seal this 26th August 1842.

    This Testament of writing was produced in court and proven to be the last Will and Testament of Joseph Loving dec'd by the oaths of Samuel B. Earle and Orlando S. Allen subscribing witnesses thereto & ordered to be recorded. Whereupon the [same] is recorded accordingly.
