The following land records have to do with John's children selling the land he owned.

Know all men by these presents that I Isaiah Smelser of the County of Siskiyou in the State of California have this day by my attorney in fact William Prigmore of the County of Lafayette in the State of Missouri for and in consideration of the sum of Six Hundred and fifty Dollars to me in hand paid by Mary E Hickman Rebecca A Sample John R Smelser and Benjamin F Smelser all of Lafayette County in the State of Missouri the receipt of which is hereby acknowledged granted bargained and sold and by these presents do grant bargain and sell unto the said Mary E Hickman Rebecca A Sample John R Smelser and Benjamin F Smelser and to their heirs and assigns and to heirs and assigns of each and every one of them forever all my right title claim and interest in and to the Estate of my father John Smelser late of said Lafayette County and State of Missouri said estate being in the possession and under the control of my mother Mrs Nancy Smelser and consists of the following real Estate situate lying and being in the County of Lafayette and State of Missouri and described as follows to wit the East half of the South East quarter of section Eight in Township forty niine of Range Twenty four Also west half of the south west quarter and the East half of the north west quarter of section nine (o) in Township Forty nine (49) of Range Twenty four (24) Also the west half of the north East quarter and the East half of the South East quarter of section seventeen (17) in Township Forty nine (49) of Range twenty four (24) Also the following named negroes slaves for life namely a negro woman named Patscy aged about sixty years and one negro man named Dock aged about thirty years
To have and to hold the said real Estate above described together with all the rights priveleges and apprustenances (?) thereto belonging as well as all my right title claim and interest in and to said negroes (slaved unto them the said Mary E Hickman Rebecca A Sample John R Smelser & Benjamin F Smelser and to their heirs and assigns forever And I the said Isaiah Smelser by my Attorney in fact hereby covenant and agree to and with said Mary E Hickman Rebecca A Sample John R Smelser and Benjamin F Smelser their heirs I to warrant and forever defend the title said real and proven al property against the lawful claims of all persons claiming by through or with me in any manner whatsoever In testimony whereof I ?? said Isaiah Smelser by William Prigmore my attorney in fact have hereunto set my hand and seal this 6th day of August A.D. 1862

Know all men by these presents that we William Sample and Rebecca A Sample his wife John R Smelzer and Sarah Jane Smelzer his wife and Benjamin F Smelszer of all Lafayette County Missouri Heirs and distributes of John Smelzer deceased having made a partition of the lands in part which descended to us and to William Hickman & Mary E Hickman his wife we the said William Sample & Rebecca A Sample his wife representing one distributee and obtaining one share John R Smelzer one share Benjamin F Smelzer one Share and William Hickman and his wife Mary Hickman one share Now for the purpose of effectionatiny? the partition we heirs made among ourselves we mutually agree to give each other quit claim deed for the lands which by partition fell to each heir therefore Know all men that we the three ?eotnlawtees? first above named in the deed have for and in consideration of the premises do well as for and in consideration ofthe Sum of one dollar to us paid by the said William Hickman and Mary E Hickman the receipt of which is hereby acknowledged have sold transferred and conveyed and do by these presents sell transfer convey  ????? and give unto the said William Hickman and his heirs all the right title claim and interest we and each of us have in and to the following tracts of land situated in Lafayette County aforesaid named the North East quarter of the South East quarter of section seventeen in Township forty nine (49) of Range twenty four (24) and also one equal third part of the East half of the North West quarter of Section nine (9) in same Township of Range ?? be taken by straight line from the South end of said east half of said north west NOTE:last line of page cut off when copied

containing sixty six acres and sity six hundredth of one or ? more or less do have and to hold this above described real Estate with all and singular this rights priveleges and app(dark area) tenances there unto in any wise belonging unto the said William Hickman and his heirs and assigns forever and we hereby covenant to and with him for ourselves to warrant and defend the title of the above described lands free from all persons claiming the same in through or by us. In witness whereof we hereunto subscribe our hands and afix our seals this 16th day of December 1862.
