In the name of God Amen The three and twentieth day of November in the year of our Lord God one thousand six hundred and fiftie I John Payton the yonger of the parish of Dudley in the County of Worcester yeoman being sick in body but of sound and perfect mynde and memory praise be given to All mighty God make and ordayne This my last will and Testament in manner and forme following First and principally I commend my soule into the hands of All mighty God my maker and Creator trusting through his mercie and meritts of my only Lord and Saviour Jesus Christ to be made partaker of Everlasting joye and glory in his heavenly kingdom of glory And my bodie I commend to the Earth whereof it was made to be decently buried at the discretion of my welbeloved wife trusting in my Lord God and Saviour to have a joyfull Resurrection at the last day And touching my worldly estate and goods whereof it hath pleased God to bless mee with I dispose of in manner and forme following First I give devise and bequeath unto John my eldest sonne and his heyers forever my dwelling house or Tenement barnes stables gardens with the appurtenances and all those closes grounds and pastures called the Little Tensley as it is now in three partes devided Item I give and devise unto my sayde sonne John and his heyres forever all those two cloases called great Tensley with thappurtenances Item I give and devise unto my sayd sonne John and his heyres forever all those my lands called Bare hill which I purchased of the Lord Ward with the appurtenances upon the condicion herein expressed Item I give and bequeath to my sayd sonne John all those houshold goods that my father hath devised and given to mee by his will. Item I give and devise to my seconde sonne Timothy Payton and to his heyres for ever All those lands called Crookeslands with thappurtenances lying and being in Dudley in the County of Worcester which I had and purchased of Mr Richard Foley upon the condicion herein expressed That he well and truly pay or cause to be paid forth of the sayd Crookeslands To my daughter Margaret the summe of Tenn pounds And to my sonne Thomas other Tenn pounds And to my sonne Samuell Tenn pounds of lawfull money of England to be paid within three years after the decease of Mary my welbeloved wife unto whom I give and devise the foresayd house lands Tenements and hereditaments To hold to her and her assignes for Terme of her naturall life if in case shee continue and keepe herselfe widdow and in my name Item I give to my sayde oldest sonne three of the best Timber Trees that are standing and growing in and upon the sayd Crookeslands for and towards reparasions of my sayd house and barnes to bee felled and carried away at the pleasure of my sayd sonne John Item whereas my sayd father hath given and appointed to the poore of Dudley for ever Tenn pounds to be preserved and kept as a stock in my hands and my heyres for ever paying to the poore yearely at the feast of St Thomas Apostle tenn shillings for the interest of the same my will and true meaning is and I doe soe desire it that my parcell of lands in Peacocks feilds contayning three quarters of an Acre and lyeing between the lands of Oliver Dixon and the schoole lands which I bought and purchased of Robert Chattam and Christian his wife (amongst other lands) that the rents yssues and profitts thereof shall be charged forever with the sayd Tenn shillings rent and distribution And I doe hereby charge and require my sayd sonne John and his heyres to be carefull that the sayd Interest be duely distributed according to my sayd fathers guift and appointment Item I give and devise to my third sonne Thomas Payton and his heyres for ever my Cloase of land with the appurtances called the Overhouse Crofte lyeing betweene the lands of the sayd Robert Chattam and Christian his wife on the one parte and of Richard Shawe of the Pinfolds on the other parte which cloase or parcell I purchased amongst other lands of the sayde Lord Ward Item I give and devise to my yongest sonne Samuell Payton and his heyres forever all that my Cloase called the netherhousecrofte with the appurtenances which I likewise had and purchased of the Lorde Ward And also I give and devise to my sayd sonne Samuell and his heyres for ever one Acre of land with the appurtenances in Peasants feilds which I also had and purchased of the sayd Robert Chattam and Christian his wife Item my will and meaning is And I doe soe devise it that my sayd wife shall have hold and enjoye to her and her Assignes during her naturall life the foresayd two Cloases called the Overhouse Croft and the Nether house Croft and the sayd Acre of land if in case shee continue soe longe in my name and keepe her selfe widdowe But in case shee marrye againe then shee to have and hold the moyetie of the lands to her devised Item I give and devise to my sayde daughter Margaret to bee paid her by myne Executors other threescore pounds when shee my sayde daughter shall attayne to the age of five and twenty yeares But in case shee marrie in the meanwhile with her sayd mothers consent and my eldest sonnes good likeing I doe desire and soe appoint it that my sayd Executors doe cause the sayd sixty pounds to be paid and contented to her at the day of her marriage Item my will and true meaning is And I doe soe devise it that in case my eldest sonne should dye without issue of his body lawfully begotten and that my house and the lands tenements and hereditaments to him devised doe come and desende to my sayd second sonne then the sayd Crookse lands to him devised I give and bequeath to my sayd two yongest sonnes Thomas and Samuel and to the heyres of them for ever to bee equally devided betwixt them Item I doe devise and give to my sayd daughter Margaret other thirty pounds to be paid her at her marriage in case shee marrye with her sayd mother and eldest brothers consente and good likeing But if shee marrys contrary to their good likeing and consente then my will and meaning is that shee shall have noe benefit of the sayd thirty pounds but that the same shall remayne to my Executors Item I doe ordayne and constitute my sayd wife and my sayd sonne John Payton Executors of this my sayd will And doe hereby revoake and disannull all former wills by me formerly made And I doe request my two brothers Thomas Payton and Henry Payton to bee overseers And I doe devise to them for their care and paines herein five shillings a peece And after my funeral expences debts and Legacies paid the surplussage of my goods [...] chattells and Cattells I doe devise and appoint (after the decease of my sayd wife) to be equally distributed amongst my sayd children Item I give to the poore of the parish and Towne of Dudley Twenty shillings to be sent them to their houses at the discretion of my sayde Executors and Overseers And to my servant Deborah Brasenell Tenn shillings In wittnesse whereof I have to this my present will contayned in two sheetes of paper sette my hand and seale the day and yeare first above written John Payton signed sealed     The Will was proved at London before Sr Nathaniell Brent Knight doctor of Lawes and Master Keeper of the Prerogative Court the fifteenth day of May in the yeare of our Lord God one thousand six hundred fifty one by the oaths of Mary Payton the Relicte of the sayd deceased and Executrix and John Payton the naturall and lawfull sonne of the said deceased and Executor herein named To whome Administration of all and singular the goods chattells and debts of the sayd deceased which any manner of way [...] the sayd will was graunted and committed they being first legally sworn by virtue of Commission in that behalfe issued forth well and truely to Administer the same
