    To all Christian people to whome this writing Shall come Anthony Day of Glosster in the County of Essex in New England Shipwright Sendeth greeting
    Know ye that I Anthony Day and my wife Susannah Day devise and bequeath unto our Son John Day to him & his heirs for Ever that parcel of land on which his house now Standeth & Lyeth within his owne fence as follows that small parcel of ground which lyeth below ye highway over against his house & is also with his own fence both said parcels of land I the said Anthony Day Doe give grant & confirm to my Son John . . .with this provisall or Caution which is that if my son John shall have a mind to sell of above sd Land then he Shall give his brother Either of them ye refusal of said Land which if they will give a sufficient price for his housing & Said ground then he Shall Sell it to one of them & if not then Shall he be free from this Ingagement . . . .

    p. 206-207 - Indian War of 1675 [King Philips War] had little effect on Gloucester because of isolation. In the fall, a large force was called out, raised by levey upon all towns; persons drafted in Gloucester were to be given warm clothing and new coats. John Day (who may have gone as a substitute for one of the others drafted) received a grant of land at Kettle Cove on 16 Dec. 1679 for his service
    p. 79 - John Day had a house near Poles. He married Abigail Lead [sic], Dec. 12, 1681; had several children, but probably no son that lived to mature years.

    Day, John, Gloucester int[estate], 1742 Oct 21
    John Day died intestate. His heirs (widow Rachel, daughters Bethia (wife of John Merchant/Marchant), Elizabeth Giddings, Abigail (widow of _____ Jackson), and Sarah (wife of Joseph Winslow)) signed an Agreement on the "Division and Distribution" of John's estate, both real and personal. (pp. 40-42). They also agreed that Sarah's husband, Joseph Winslow would act as their Attorney
    Joseph Winslow was appointed Administrator of John's estate on 31 Oct 1737 (p. 38) The estate was settled with a final accounting on 9 Aug 1742 (pp. 45-6). As Administrator, Joseph Winslow paid the debts owed by John, as well as the costs associated with the settlement of the estate. Among those payments was one for digging John's grave, made on 20 March 1737 (p. 27), and one made 22 March 1738 to a Joseph Day (p. 34). In at least one instance, on 6 July 1742, Elizabeth Giddings appears to have acted as an agent for Joseph Winslow (p. 6)
