Facts and Events
James D. Fouts was born 10 Aug 1810 (per tombstone) in Wilkes Co, NC (per 1850 and 1860 census). What does his middle initial stand for? James seems to be home with his parents for the 1810 census (aged "under 10", born ca 1800/10, though it is possible this is not him), and still home in 1820 (aged "under 10", born ca 1810/20), and still home in 1830 (age 15-19, born ca 1810/15). James moved with his parents and siblings to Macon County, North Carolina in the 1830's. In July 1835 Court, James D. Fouts and others (including J. M. Waters, actually M. J. Waters, his brother-in-law) were bondsman for Eli Collins to become Constable. (Macon Co, NC Court Minutes 1833-1836 pg 86). On 21 Jan 1836, James Fouts obtained a marriage bond in neighboring Haywood County to marry Rebecca Barnes. The marriage bond listed her father as Thomas Barnes. Elihu Barnes was bondsman. Rebecca was born 16 May 1818 (per tombstone) in Burke County, North Carolina (per 1850 census) or Iredell County, NC (per 1860 census), daughter of Thomas Barnes and Elizabeth ---. On 12 Nov 1836, Samuel H. Waters (brother-in-law) sold James Fouts 72 acres on Burningtown Creek. The deed was witnessed by Eli Collins and William Fouts (brother) (Macon Co, NC Deed Book C page 1143) On 12 Dec 1836, James Fouts received two State Land Grants in Macon County, one for 50 acres, and one for 153 acres. (Macon Co, NC Deed Book C page 1119 and 1120) James Fouts was listed as a juror in January 1839 Court. (Macon Co, NC Court Minutes 1833-1836 pg 25). James Fouts was listed on the 1840 census in Macon Co, NC. They were next do Michael J. Waters (married James' sister Rebecca Fouts), and Elihu Barnes whom I think is Rebecca Barnes Fouts' brother, or at least somehow related to her. James Fouts had several "extra" young people with him, who were they? No way to be sure.
James Fouts and brother-in-law M. J. Waters and others were named as jurors in January 1840 court. (Macon Co, NC Court Minutes 1838-1855 pg 72.) James Fouts was listed as a juror in June 1840 court. (Macon Co, NC Court Minutes 1838-1855 pg 93.) James Fouts was listed as a juror in September 1840 court. (Macon Co, NC Court Minutes 1838-1855 pg 109.) James Fouts was listed as a juror in March 1841 court. (Macon Co, NC Court Minutes 1838-1855 pg 132.) James Fouts was listed as a juror in April 1841 court. (Macon Co, NC Court Minutes 1838-1855 pg 142.) James Fouts and brother-in-law Samuel H. Waters and others were named as jurors in April 1842 court. (Macon Co, NC Court Minutes 1838-1855 pg 185.) James Fouts and brother-in-law Samuel H. Waters and others were listed as jurors in September 1843 court. (Macon Co, NC Court Minutes 1838-1855 pg 225.) In March 1844 James Fouts returned his road order (meaning he resigned his position as overseer of the road). I did not see the record where he was appointed overseer of a road. (Macon Co, NC Court Minutes 1838-1855 pg 245.) On 12 Jun 1844 two tracts of James Fouts' land was sold by Thomas M. Angel, Sheriff of Macon County, to Jacob Shope (highest bidder) at public auction to satisfy a court judgment against James Fouts. The tracts were 50 acres and 153 acres (Macon Co, NC Deed Book D page 1728 and 1730) On 26 Aug 1848 James Fouts sold 75 acres on Burningtown Creek to John Revell. Witnessed by Henry Deweese and David Younce. (Macon Co, NC Deed Book I page 81). On 13 Dec 1848 Bynum W. Bell and Jacob Fouts sold 153 acres to James Fouts. Witnessed by Z. Evans (Zachariah Evans). (Macon Co, NC Deed Book F page 103). In December 1849 court, James Fouts, Jacob Fouts (his father) and Richard Clampett (brother-in-law) and others were named as jurors to lay off a road. (Macon Co, NC Court Minutes 1838-1855 pg 429.) James and family were listed on the 1850 census in Macon County. Rebecca's parents were living with them.
On 12 Sep 1851 James Fouts sold 157 acres to Jesse R. Siler. Witnessed by J. T. Siler and John Davis. (Macon Co, NC Deed Book F page 352). On 10 Dec 1852, James Fouts received a State Land Grant for 27 acres on Burningtown Creek, entered on 21 Mar 1849. (Macon Co, NC Deed Book G page 415). On 17 Mar 1853 James Fouts sold 27 acres on Burningtown Creek to J. R. Siler. Witnessed by J. F. Slagle, and William Addington. (Macon Co, NC Deed Book G page 135). On 12 Apr 1853 James Fouts received a 65 acre State Land Grant on Tennessee River bordering William Fouts and D. Fouts (probably meant to say D. Younce). entered 11 Apr 1850. (Macon Co, NC Deed Book H page 74). On 15 Dec 1856, James Fouts received two State Land Grants, one for 80 acres, and one for 68 acres. (Macon Co, NC Deed Book I page 121 and 122). James and family were listed on the 1860 census in Macon County, just three houses from David Younce and wife Susan Fouts (James' sister).
James and family were listed in Franklin Township for the 1870 census. Rebecca Woodfin, age 80 (born ca 1790 SC) was living with them, and listed as a pauper. Is she related somehow?
They were still in Franklin Township for the 1880 census.
James D. Fouts died on 16 Aug 1890, and Rebecca Barnes Fouts on 18 Dec 1899. They are buried at the Fouts Cemetery in Macon County. |
