  19. His Declaration of Intent was sworn 28 Mar 1894. His Homestead Application No. 9562, date 28 Mar 1894, was accompanied with a Homestead Affidavit of the same date. Both contain his signature. The Affidavit states that because of distance, he was unable to appear at the District Land Office in Aberdeen, SD and therefore made application at the Office of Clerk of Circuit Court in Mound City, SD. He stated that he was from Eureka, SD and had declared his intention to become a citizen. The Application was for the South Half of the North East Quarter and the North Half of the South East Quarter in Section 11, Township 126 North of Range 74 West of the 5th PM, containing 160 acres--(Amended to just the South East Quarter of Section 11 per Commissioners letter of November 8, 1894). He paid the $14 fee for the land entry, which was recorded on a Receiver's Receipt on 30 Mar 1894.
    Jakob appeared in Circuit Court of McPherson County, SD on 20 Jan 1900 and applied to be admitted to become a citizen of the USA. Having produced the necessary evidence and taken the required oaths, it was ordered by the Court that he should be admitted, and he was accordingly admitted by the Court to become a citizen.
    In September 1900, Jacob Ottenbacher Jr. of Eureka, Campbell County, SD gave notice of his intention to make final proof on the 3rd of Nov 1900 to establish his claim before the Clerk of the Circuit Court of Campbell County at his office in Mound City, SD, and he named four potential witnesses. Accordingly, notice was posted for thirty days in the Register's office at the Land Office at Aberdeen, SD beginning on 18 Nov 1900. Notice was also published for six consecutive weeks in The Northwest-Blade, a weekly newspaper published in Eureka, McPherson County, SD. The first publication being made on 27 Sep 1900 and the last on 1 Nov 1900.
    On the appointed day of 3 Nov 1900, Jakob appeared before the Clerk of Circuit Court and signed a Non-Mineral Affidavit stating that, to his knowledge, there were no mineral deposits on the land. In addition, he signed the Final Affidavit Required of Homestead Claimants and his Homestead Proof Testimony. Johann Stadel and Johann Retzlaff testified as witnesses. Jakob testified that he was age 29 and a naturalized citizen of the United States, that he had a wife and two children and that they had resided continuously on the land since establishing residence 30 March 1894. He further testified that he had built a sod house 16X20, a sod stable 22X36, a mud granary 12X14, a well and had 82 acres broken; value $350. He had 82 acres cropped for six seasons.
    It was necessary for Jakob to appear in Circuit Court again, which he did on 20 Nov 1900, signing an affidavit describing a problem of not receiving a duplicate receipt after an amendment was made on his homestead entry. Therefore, he was unable to produce the receipt and asked that the Register and Receiver of the Land Office would accept his affidavit in lieu thereof and allow final receipt to issue and go of record. Copies of Post Office return receipts were included in the file. One receipt, dated 12 Nov 1900, showed that Jakob had signed for a registered letter parcel from the Post Office at Aberdeen. The other, with a Eureka postmark dated 17 Nov 1900, appears to be a "Return to sender" (which was the Land Office at Aberdeen) and appears to have been stamped "Filed" on 19 Nov 1900. A Final Receiver's Receipt, dated 22 Nov 1900 shows that Jakob paid the $4 balance due for the land entry, and it is noted that $1.20 was received for Testimony fee for 800 words at a rate of 15 cents per 100 words. A Register and Receiver's Report was included in the file. It was undated but appears to be a checklist verifying that everything was in order.
    Final Certificate No. 4831, dated 22 Nov 1900, was issued stating that Jakob Ottenbacher Jr. had made payment in full for th South East Quarter of Section 11 in Township 126 N, of Range 74 W, of the 5th Principal Meridian and that he was entitled to a patent for the tract of land. It was approved 12 April 1901, and patented 8 June 1901; Recorded, Vol 232, page 127; Land Office at Aberdeen, SD.
