    [Henry KEINERT, administrator of Frederick Keinert, deceased, reported that no. 1, containing 22 acres, 76 perches, and no. 2, 1 acres and a half, were sold to John Fake for $390.37 1/2. Sale confirmed.

    Had Frederick left a will, the family home could have been left to a single heir but dying intestate required the court to provide an inheritance to all the heirs; hence, the land had to be sold and the proceeds divided among the heirs.

    Now, who was John Fake?
    In 1850 census, a John Fake, 45, is living in Lower Windsor near the lands of Samson Immenheiser and Michael Keinard. John is married to Lanah, 35 (c 1815). Was John just a willing buyer?]

    [Orphans Court: "the said Frederich Keinerd died intestate leaving four sons and the children of one now deceased, viz: Henry, this petitioner, Michael, Daniel and George - and Sarah, Louisa, Nancy, Janey(?), Rebecca, Jacob, Leah, John and Joshua children of John Keinerd deceased, and seized in fee of a certain tract of land, containing 22 acres and 76 perches, with the apportenances situate in Windsor Township, adjoining lands of Samuel Emenheiser (?), Henry G. Slaymaker and others; also seized in fee of another tract of land, containing about 2 acres and a half, situate in Windsor Township adjoining the lands of Daniel Keinerd, Peter Keller and others."

    The court, on petition of Henry Kinard, filing on behalf of all the heirs, orders an inquiry by the sheriff as to whether the real property can be partitioned "without prejudice to or spoiling the whole but if such partition cannot be made thereof, then to value and appraise the same" and report back to the court.]

    [The sheriff with 12 men of the county went to the lands of the deceased and concluded that the property could not be partitioned without prejudice to or spoiling the whole, "but that the same could be divided in two parts so as conveniently to accommodate two of the heirs without prejudice to or spoiling the whole": Number one, "the mansion place adjoining lands of Samuel Emenheiser and others, with a one story log dwelling house, barn and other out houses" appraised at $350.00. Number two, a tract of woodland adjoining lands of Daniel Kinard and others, appraised at $40.00.

    The court requires the heirs to appear before the court and accept or refuse the valuation of the property or show cause why it should not be sold.]
