Aaron Biggerstaff

"Know all men by these presents that we Thomas Biggerstaff, Samuel Biggeerstaff, John Biggerstaff, James Shepard and Elizabeth his wife late Elizabeth Biggerstaff, Moses Etherton and Nancy his wife late Nancy Biggerstaff, Nicholas Phelps and Mary his wife late Mary Biggerstaff and Alexander Whittaker and Susanna his wife late Sussanna Biggerstaff, of the Commonwealth of Kentucky of Rutherford County and State of North Carolina for divers good causes and considerations us hereunto moving have made, ordained, constituted and appointed and by these presents do make, ordain, constitute and appoint our trusty friend John S. Eaves of Muhlenberg County and Commonwealth aforesaid our true and lawful attorney for us and in our names to sell dispose of and convey to the purchaser or purchasers all the right, title, interest and claim which we have in and to two hundred and fifty acres for land be the same more or less lying and being in Rutherford County, North Carolina which said tract of land was willed by our father to our brother Benjamin Biggerstaff reserving to our Mother her lifetime in the same will more fully appear by the last Will and Testament of the said Aaron Biggerstaff deceased and our brother Benjamin having also departed this life previous to our aforesaid Mother and leaving no issue of his own body whereby we become the heirs of the estate of which he died seized and possessed in and to the said land after the decease of our said Mother and she having previous to her death sold her life estate in and to said tract of land she also having departed this life in the month of March in the year 1806 whereby we become the sole heirs and devisees of said land after the death of our said Mother. We do therefore by the presents empower our said Attorney to do and act for us in the premises in disposing of the same and making or causing to be made made such deeds of conveyance to the purchaser or purchasers as he may be advised will be agreeable to Justice and equity and to receive payment therefor and give such receipt and acquitance therefor as the law may require and we do clothe our said attorney with all the power that we possess in selling and the conveyance of the said land in all things as completely as tho we were personally present to do the same and we do authorize our said attorney to bring suit or arbitrate in our names for any rents due or arearages that may appear lawfully due to us hereby ratifying and confirming what our said attorney may do in the premises to be full and complete. In testimony Whereof the said heirs and legatees have hereunto set their hand & seals this 25th day of July 1812.

The above and within power of attorney from the heirs of Aaron Biggerstaff deceased of the one part to John Eaves of the other part was proved by the oaths of William Biggerstaff and John Whittaker to be their act and deed which is therupon admitted to record. Att. Chas. F. Wing C.M.C.C.
