STATE OF ALABAMA DEKALB COUNTY

Know all men by these present that we Elizabeth S. McSpadden, John McSpadden and _______ are held and firmly bound unto Reuben Estes, Judge of the Probate Court of the County and State aforesaid and his sucessor is office in the penal sum of Four Thousand Dollars, for the payment of which will and truly to be made, we and each of us bind ourselves, our heirs, executors, and administrators, jointly and severally, firmly by these present, signed and sealed this 16th day of February, A. D. 1856.

The condition of the above obligation is such that whereas the above bound Elizabeth S. McSpadden has this day been appointed Guardian of Samuel M. McSPADDEN, Amelia Jane McSpadden, Rececah Virginia McSpadden, William R. McSPADDEN, and John W. McSPADDEN, minors, heirs of Moses McSpadden, dec'd.

Now, if the said Elizabeth S. McSpadden shall well and truly discharge all the duties that are or may be required of her by law, as such Guardian, then this obligation to be null and void. Otherwise to remain in full force and virtue.

THE STATE OF ALABAMA DEKALB COUNTY

In the Probate Court of said County, March 12th, 1860.

To any sheriff of the State of ALABAMA. You are hereby commanded to summons:

Samuel D. McSPADDEN, Margaret L. LARMORE, Emelia E. DAVENPORT and Rebecca DUFF; and Pleasant D. PHILLIPS, guardian ad litem of Hiram A. McSPADDEN, next of kin and minor heir of John McSPADDEN,deceased, to appear before the Probate Judge of said County on the 22nd day of March, 1860 at a Special Term of the Probate Court to be held for said County at the Courthouse thereof, there and then, to show if they have any thing to alledge against the application of T.K.B. McSPADDEN who has exhibited before the said Judge a paper perporting to be the last will and testament of the said John McSPADDEN, dec'd, and made suit to have the same admitted to Probate and to grant to the said T.K.B. McSPADDEN letter testamentary in the estate of the said John McSPADDEN. Therein fail not and have then and there, ...(the persons named).

Estate of Elizabeth McSPADDEN, Petition to sell land, filed by Admin.,15 April 1870 in Dekalb Co., Alabama Probate Court. Transcribed by Dorothy Duff, 8 October 2000.

To the Hon. A. J. HORTON, Judge of Probate for the County of Dekalb in the State of Alabama.

Your petitioner respectfully represents unto your Honor that Elizabeth S. McSPADDEN, late widow and relict of Moses McSPADDEN, dec'd., departed this life intestate in the County and State aforesaid on or about the __ day of February 1863 being seized in fee of the following real estate to wit- the N.E. Qt.and the N.W. QT of the S. E. Qt of Sec. 32. The S. l/2 of the S.W. Qt of Sec. 28 and ten acres off the S.E. corner of the S.E. Qt of Sec. 29 adjoining the lands of Andrew Brock, all in Township 6, Range 9, East in said County.

That the said Elizabeth McSPADDEN left the following children, who are still living, her sole heirs at law, to wit - Amelia Jane McSPADDEN, aged about 24 years; Wm. Rupell McSPADDEN, aged about 20 years; John Willoughby McSPADDEN, aged about 17 years; all of whom reside at Ladi? in Washington County, Virginia.

That petitioner is the Admin. of the said Elizabeth. That said estate is indebted to the amt. of about $250.00 and no personal assets to pay the same. That it is necessary to sell a portion of said lands to pay said debts.

That the remainder of said lands cannot be equally and fairly divided among said heirs without a sale thereof and that it would be to the interest of said heirs to sell said lands for distribution. He therefore prays your Honor for an order to sell said lands for the purposes above specified and he will ever pray.
