Document 1 THIS IS THE LAST WILL AND TESTAMENT of me FRANK BONE EBBOTT of 16 Lysterville Avenue Malvern in State Victoria Merchant.

I HEREBY REVOKE all former testamentary dispositions heretofore made by me I APPOINT as executor of this my will and trustee to my estate my son REGINALD HARRY EBBOTT I GIVE DEVISE AND BEQUEATH the whole of my estate of whatsoever nature and wheresoever situate unto my trustee upon the following trusts -

1. TO pay my debts funeral and testamentary expenses state probate and federal estate duties (if any). 2. TO stand possessed of the rest and residue of my estate upon trust a) To give my house and land and furnishings and personal effects situate in such house known as No. 16 Lysterville Avenue aforesaid to my wife NANCY MAY EBBOTT absolutely. b) To give any land I may own situate at Warrandyte or in the district neighbouring thereto to my son the said Reginald Harry absolutely. 3. NOTWITHSTANDING anything hereinebeofer contained to the contrary I direct that should my said wife predecease me any benefit which my said wife would have received under this my will shall pass to my said son absolutely. 4. I DIRECT that notwithstanding anything hereinbefore contained to the contrary should my said son predecease me I appoint as executor of this my will and trustee to my estate my solicitor LLYD PYM GOODE And I direct that the share which my said son would have received under this my will had he survived me including any share which he would have received in the event of my said wife predeceasing me shall be held in trust by my trustee to pay the income accruing therefrom the use and benefit of his wife JOYCE for the maintenance advancement and education of my grandchildren TIMOTHY and ANGELA and I DIRECT that when my said grandson Timothy shall attain the age of twenty one years my trustee shall five to my said grandson two -thirds of the share of the corpus ;and income thus held absolutely. Document 2 Affidavit of Mr. L.P. Goode IN THE SUPREME COURT OF VICTORIA PROBATE JURISDICTION In the WILL of FRANK BONE EBBOTT late of 16 Lysterville Avenue Malvern in the State of Victoria Merchant deceased. I, LLOYD PUM GOODE of 475 Bourke Street Melbourne in the State of Victoria Solicitor make oath and say:- 1. THAT I am the Solicitor acting on behalf of Reginal Harold Ebbott of 86 Wattle Road Hawthorn in the said State the Executor of the Will of the abovenamed deceased. 2. THAT the reason for the delay in lodging the said application for the grant of Probate herein arose in obtaining the information of the value of the assets consisting of shares owned by the deceased in Hasler Construction Proprietary Limited and this Company was also indebted to him in considerable sums. This Company is a Proprietary Limited Company which has not been in existence for a great length of time and I am informed and verily believe that the Accountant while truing to check the shares in the Company met with considerable difficulty while he ascertained that the Company was engaged uncertain large construction works which were partly completed and it proved very difficult to ascertain the value of the work done especially in view of the fact I am informed and verily believe many of the usual books and records which are kept by Companies of a similar nature were not kept in this case consequently the only practicable method of establishing the true value of the assets was to attempt negotiations for the sale of these shares and the realisations of the indebtedness and finally the best offer received thus formed the basis for the valuation shares the shares of the true value of the amount of the indebtedness by the Company to the deceased. Sworn at Melbourne in the State of Victoria this thirteenth day of April One thousand nine hundred and forty-nine

Document 3 The following advertisement duly appeared in the Argus newspaper published in Melbourne on the tenth day of August One Thousand nine hundred and forty-eight. FRANK BONE EBBOTT late of 16 Lysterville Avenue, Malvern in the State of Victoria Merchant deceased. After fourteen clear days REGINALD HARRY EBBOTT of 88 Wattle Road, Hawthorn in the State of Victoria Estate Agent the Executor and Trustee appointed by the deceased's Will dated the thirtieth day of June One thousand nine hundred and forty-seven WILL APPLY to the Supreme Court of Victoria for PROBATE of the said Will. LLOYD P. GOLODE LL.B of 475 Bourke Street, Melbourne Solicitor for the Applicant..
