B. C. Day & wife

Robert Madison

This indenture made and entered into this 14th day of March 1850 between B. C. Day of Harrison County and State of Ky. of the one part and Robert Madison of the County and State aforesaid of the other part. Witnesseth that the said B. C. Day, for and in consideration of the sum of five hundred and forty seven dollars and fifty cents to him in hand paid the receipt whereof is hereby acknowledged have given, granted bargained, sold, released, conveyed, and confirmed and by these presents doth give, grant, bargain, sell, release, convey and confirm unto the sd. Robert Madison and his heirs all that certain tract or parcel of land lying and being in the County of Harrison & State of Ky. on the waters of Mill Creek and bounded as follows Viz: Beginning at a stone in said Madison's line corner to B. C. Day, then with sd. Madison's line S 10 poles to [Point] B a box elder thence S 34 E 79 poles to a box elder on the bank of Mill Creek corner to Madison thence down the creek with the meanders thereof to high water mark N 14 E 17 poles to [Point] D then N 5 W 34 poles to [Point] E thence N 15 E 12 poles to [Point] F thence N 40 E 25 poles to [Point] G a stone near a box elder on the bank of Mill Creek corner to B. C. Day thence with his line S 76 W 63 poles to the beginning containing 14 acres 2 roods [sic] and 16 poles. To have and to hold the above described tract or parcel of land and every part and parcel thereof and the appurtenances to the duly proper use benefit and behoof of him the sd. Robert Madison and his heirs forever. And the title to said tract or parcel of land and every part and parcel thereof and the appurtenances thereto doth warrant and defend to the said Robert Madison and his heirs and assigns forever against the claim or claims of him the sd. B. C. Day and against all other claims whatsover. In testimony of which the sd. B. C. Day hath hereunto subscribed his name and affixed his seal the day and date first above written. Mary Day the wife of the said B. C. Day acknowledges her right of dower to the said premises.

I Thomas B. Woodyard Clerk of the County Court for said county certify that this deed from B. C. Day and Mary H. his wife to Robert Madison was produced in my office on the 14th March 1850 and acknowledged by said Day to be his act and deed. And the said Mary being examined by me privily and apart from her said husband declared that she did freely and willingly seal and deliver said writing and wished not to retract it and acknowledged said writing again shown and explained to her to be her act and deed and consented that the same might be recorded which is accordingly done this 16th Oct 1850.
