30th January 1826, Deed of Sale by Samuel Rollins & Joel Rollins to John Seelye

Before the subscribing witnesses residing at St. Armand in the county of Bedford in the District of Montreal in the Province of Lower Canada personally appeared Samuel Rollins of the Township of Dunham, yeoman, and Joel Rollins of the Township of Stanbridge, trader, said Towns lying in the County aforesaid, brothers who, in the presence of the said Witnesses, voluntarily declared and acknowledged that for and in consideration of the sum of three hundred dollars, one hundred & three dollars & fifty eight cents whereof they the said Sam’l & Joel Rollins do hereby acknowledge to have had & received of John Seelye of said Dunham, yeoman, wherefore quit: and the remainder to wit; one hundred & ninety six dollars and forty two cents to be paid by the said John Seelye to James Rollins of said Dunham, yeoman in manner and at the periods herein after mentioned, they the said Sam’l & Joel Rollins have bargained, granted and sold, and by these presents do bargain, grant, sell, alien, enfeoff, convey and confirm, from henceforth forever, unto the said John Seelye, present hereto & accepting the one equal quarter or fourth part of all that tract of land situate lying & being in the aforesaid Township of Dunham known & distinguished by Lot number eighteen in the fifth Range of Lots in the said Township; the one quarter or fourth part of said Lot consisting of the equal southerly moiety of the northerly half of the said Lot which said quarter part is severed from the said north half by a line drawn through the center thereof parallel with the southerly boundary line of said Lot as the said piece of land it, with all the improvements erected & made thereon and generally all and every the Estate and Estates, Rights, Titles, Interests, Property, Claims and Demands whatsoever of them the said Sam’l & Joel Rollins of, in, to, or out of the said quarter part of Lot of land and premises, and of, in and to every part and parcel thereof, as the same was unto them conveyed by {Josiah} Geer by Deed, dated the 23rd Oct AD 1821, executed before Léon Lalanne, Notary Public. TO HAVE and TO HOLD the said quarter or fourth part of Lot of land and premises, and every part and parcel thereof, with its appurtenances unto the said John Seelye his Heirs and Assigns to the only use and behoof of the said John Seelye his Heirs and Assigns forever by virtue of these presents; subject to the terms & conditions, provisos, limitations, restrictions and reservations in the letters Patent of the said Township of Dunham set forth & contained.

And the said Sam’l & Joel Rollins in the presence of the said Witnesses for themselves, their Heirs, Executors, Curators and Administrators did and do hereby grant, covenant to and with the said John Seelye, his Heirs and Assigns, that they the said Sam’l & Joel Rollins and their Heirs, the said quarter part of Lot of land and premises, and every part and parcel thereof, with all and singular its rights, members and appurtenances unto the said John Seelye his Heirs and Assigns against them the said Sam’l & Joel Rollins and their Heirs, and against all persons whomsoever, shall and will warrant and forever defend these presents. And as to the said sum of one hundred & ninety six dollars and forty two cents remaining due the said John Seelye & his Heirs, Executors, Curators and Administrators in the presence of the said Witnesses did and doth hereby promise, covenant and agree to pay or cause the same to be paid unto the said James Rollins, his Heirs or other legal representatives or assigns in two equal payments one year _______, beginning & effectuating the first payment to wit; ninety eight dollars and twenty one cents on the tenth day of March which will be in the year of our Lord one thousand eight hundred & thirty together with the lawful interest for & upon each payment computed from the day of the date of these presents, the one half of each payment payable in good merchantable meat stock and the other half in cash, the stock deliverable upon the premises, for securing the which payment and every of them, the said John Seelye did thereby doth especially bind & particularly bind, mortgage and hypothecate all & singular & solely the hereby sold & demised quarter of Lot of land & premises upon which the said James Rollins doth hereby expect to reserve for himself his heirs & assigns the ___________ privilege of ___________ defond, as grantor thereof.

And for the due execution of these presents, and to the purpose of causing these presents to be duly authenticated, The Parties thereto have and do hereby make, name, constitute and appoint Simon Peter Lalanne of St. Armand aforesaid, gentleman, their true, lawful, irrevocable and respective Attorney, whom they hereby specially authorize to deposit the aforegoing Deed of sale in the office of the said Léon Lalanne, there, etc, etc, (see original), the Parties thereto have made election of their Domicil, at said Dunham. Where, &c. Notwithstanding, &c. Promising, &c. Obliging, &c. Renouncing, &c.

THUS DONE AND PASSED at said St. Armand in the office of the said Léon Lalanne absent, whether the said Parties have come for the purpose hereof in the after noon of the thirtieth day of January, in the year of our Lord, one thousand eight hundred and twenty six in the presence of ___________ Bingham & John Whitney the said Witnesses, and the said parties and we the said Witnesses have to these presents, (first duly read) set and subscribed our respective names, in faith and testimony of the premises. ________ Bingham Samuel Rollin John Whitney Joel Rollin John Seelye

BEFORE the SUBSCRIBING Notary Public, residing at St. Armand in the District of Montreal personally appeared Simon Peter Lalanne, the Attorney of and for Samuel Rollins, Joel Rollins & John Seelye, Parties to the Deed of the other parts, which said Simon Peter Lalanne, exhibiting, etc. etc. (see original) …. In the said Deed contained.

IN TESTIMONY of all which he the said Simon Peter Lalanne hath after this Act being duly read hereunto set and subscribed his name in the presence of John Porter and Elijah Kemp the said Witnesses who, with the said Notary, have also set their names, on the tenth day of February in the year of our Lord, one thousand eight hundred and twenty six. These are to make known and remembered to whomsoever it may concern, that on the thirtieth day of the present month of May A.D. 1826 at bottom of an authentic copy of the foregoing Deed a full & final acquittance by James Rollins to John Seelye of & for the rest & residue of the purchase money therein mentioned was written and before me the subscribing Notary signed & delivered by the said James Rollins to the said John Seelye.
