[edit] TextJames Cowan to Hugh, David, and William Cowan This Indenture made the fourth day of February in the year of Lord one thousand eight hundred and forty-eight
between James Cowen of Aire Township Bedford County and state of Pennsylvania of the one part and Hugh David and
William Cowen his Brothers Children of the same township and County of the other part witneseth that the said James
Cowen for and in consideration of kind services and keeping me in times past and further convennanting and agreeing
jointly to keep and provide for me during my life sufficient and comfortable aparel diet and lodging and in every resonable
way to keep and make him comfortable in the way and manner he has been kept in times past and for the said considerations
I the said James Cowen do by those presents convey make over and sign all my right title into eres claim concern and
posession of and to the undivided, half or part of a certain tract or plantation of land situate and being in Aire Township
Bedford County former Dublin Township containing One hundred and fourteen acres and lawful allowances granted to
Samuel Cowen by warrant dated 23 of June 1785 and further confirmed to said Samuel Cowen by patten bearing date 23
June 1896 [1] being left to me James Cowen by my Father the said Samuel Cowen as mentioned in those title papers. And do herby assign all my right title interest clame whatsoever to me belonging or in any ways appertaining for and in consideration of the above mentioned conditions to them Hugh David and William Cowen do hereby bind themselves
jointly and severly to faithfully and honestly to observe and keep each and every one of them said condiones in
consideration whereof I sign and convey all my right title and interest to the above mentioned plase and if they are not
fulfilled this to be null and void in testimony and confer ation where of I have hereunto set my hand and seal the day and
year above written in presence of Joseph Brown. Between 1 and thirteenth lines the undivid half or part of enterlined befor
signing. James Cowan Franklin County. 4th of February A.D. 1848 this day personally appeared the above name James Cowan before me the
subscriber one of the Justices of the Peace in and for the County of Franklin and acknowledges the above to be his act and
deed and desires it may be recorded asuch witnes my hand and seal the day an year above written. Joseph Brown
[edit] CommentaryJames Cowan apparently died without children. In old age he sought security in an agreement with his nephews for his future care and well being.. Under this agreement they were to care for him in his old age, in return for his right to a parcel of land which his father, Samuel Cowan, obtained under warrant (23 June 1785) and patents 1796. The parcel in question appears in PA Land records (See: ) as having been warranted in 1785, and surveyed/patented in 1796.
