30th Jan’y 1826, Deed of Sale by Sam’l Rollins to Joel Rollins

Before the subscribing Witnesses, residing in St. Armand in the county of Bedford, in the District of Montreal, in the Province of Lower Canada, personally appeared, Samuel Rollins of the Township of Dunham in the County aforesaid, yeoman, who in the presence of the said Witnesses, voluntarily declared and acknowledged that for and in consideration of the sum of seven hundred dollars unto him in hand well and truly paid before the execution of theses presents, by Joel Rollins, brother, of the Township of Stanbridge, in the said County, trader (the receipt and payment whereof the said Samuel Rollins did and hereby doth acknowledge, and thereof and every part thereof, acquit, exonerate and discharge the said Joel Rollins, his Heirs and Assigns forever) he the said Samuel Rollins hath bargained, granted and sold, and by these presents, doth bargain, grant, sell, alien, enfeoff, convey and confirm from henceforth forever unto the said Joel Rollins present hereto & accepting the equal undivided half & moiety of the pieces & parcels of land following, situate lying & being in the Township of Stanbridge aforesaid, that is to say; Firstly all that piece & parcel of land hereinafter described of the tract of land known & distinguished by Lot number nine in the third range of lots in the said Township, the said piece & parcel thereof extending & bounded as follows; to wit: Beginning at a stake which stands on the middle of the easterly boundary line of the said Lot thence upon this line to extend northerly three rods, thence westerly parallel with the line which divides the aforesaid Lot into two & equal northerly & southerly moieties to the easterly bank of Pike River, thence southerly to the above mentioned line of division between the said moieties of the said Lot, thence on the said divisional line to the place of beginning above mentioned. Secondly, that piece & parcel of land, containing about the one half of an acre in superficie, be the same more or less, or all the ground which may be found within the following bounds, the said Lot or piece of ground being of an irregular figure and bounded easterly & southerly by Public Roads, westerly by a Mr. Robert Burley and northerly by the above described piece of land. Thirdly & lastly, all that piece & parcel of land laid out & measured as follows, to wit: Beginning at a stake standing thirty six feet northerly of Aaron Martindale’s grist Mill in a line with the easterly wall of said Mill, thence in such southeasterly course as to pass twelve feet of the northerly wing of the dam of said Mill, & strike the River, thence up & along the Mill pond at high or common water mark to the said Martindale’s boundary line, thence northerly on said line to the highway leading to Frelighsburg, thence northwesterly along said Road to the joined points from which a line may be drawn to strike the stake above mentioned and form a straight line with the aforesaid easterly wall of the aforesaid grist Mill with their respective improvements made & erected upon each of them,

and generally all and every the Estate and Estates, Rights, Titles, Interests, Property, Claims and Demands whatsoever of him the said Samuel Rollins of, in, to, or out of the said equal undivided half of the pieces & parcels of land and premises, and of, in and to every part and parcel thereof, as the same were by him the said Joel Rollins conjointly with the said Samuel Rollins, acquired by Ephraim Knight, by Deed dated the 25th Dec’r AD 1821 executed before Léon Lalanne, Notary Public.

TO HAVE and TO HOLD the said undivided half & moiety of the pieces & parcels of land and premises, and every part and parcel thereof with their appurtenances unto the said Joel Rollins his Heirs and Assigns, to the only use and behoof of the said Joel Rollins his Heirs and Assigns forever, by virtue of these presents; subject nevertheless to the terms & conditions, provisoes, limitations, restrictions & reservations in the letters Patent of the said Township of Stanbridge set forth & contained.

And the said Samuel Rollins in the presence of the said Witnesses for himself, his Heirs, Executors, Curators and Administrators did and doth hereby grant and covenant to and with the said Joel Rollins his Heirs and Assigns that he the said Samuel Rollins and his Heirs, the said undivided half of the pieces & parcels of land and premises, and every part and parcel thereof, with all and singular their rights, members and appurtenances unto the said Joel Rollins his Heirs and Assigns against him the said Samuel Rollins and their Heirs, and against all persons whomsoever, shall and will warrant and forever defend by these presents: for which and every other purpose necessary in the premises, he the said Samuel Rollins hath made election by his Domicil, at said Dunham, Where, &c. Notwithstanding, &c. Promising, &c. Obliging, &c. Renouncing, &c. AND for the due execution of these presents, and to the purpose of causing these presents to be duly authenticated, the Parties thereto have and do hereby make, name constitute & appoint Simon P. Lalanne of said St. Armand, gentleman their true, lawful, irrevocable and respective Attorney, whom they hereby specially authorize to deposit the aforegoing Deed of sale in the office of the said Leon Lalanne there to, etc, etc, (see page 3)


THUS DONE AND PASSED at said St. Armand in the office of the said Léon Lalanne, absent, who these the said Parties have come for the purpose hereof in the afternoon of the thirtieth of January in the year of our Lord, one thousand eight hundred and twenty six in the presence of Henry M. Ayer & James Kemps, the said Witnesses, and the said parties and we the said Witnesses have to these presents, (first duly read) set and subscribed our respective names, in faith and testimony of the premises.

Before the subscribing Notary Public, residing at St. Armand personally appeared Simon P. Lalanne the Attorney of and for Samuel Rollins and Joel Rollins Parties to the Deed of the other parts, which said Simon P, Lalanne exhibiting the said Deed in the presence of ????? the??? Copy missing.
