Per Tennessee Genealogical Records: pg 39 No. not given. (below No. 1578 on page)Jones Hays of Gertford Co., NC., on 22 Feb. 1822, deeded to James Freeman of Bute Co., N.C., a military warrant that Hays became heir to for the service his father, James hays, a lieutenant in Capt. Dawson’s Co.l, in the 7th Regt. Of the N.C. Line. David Alkins and Will. Miers were witnesses. Solomon White deposed he was personally acquainted with James Hays, a lieutenant in th 7th Regt. Of the N.C. Line, and that James Hays married Winniefried Jones of Hertford Co., N.C., and had by her several children, all of whom died except Jones Hays, now living in Hertford Co., the only heir of Samuel Hays. Deposition made 23 Feb. 1822 before Joseph F. Dickinson, clerk of the county court. George H. Bond and Irvin Jenkins witnessed the deposition.

Same Source: pg 42 No. 964. James Hayes. James Brown of Gates Co., N.C. made oath on 22 Aug 1821 before Henry Gilliam, J.P., that previous to and dring the Rev. War he knew well a James Hayes who entered the N.C. army as a lieutenant marched to the north where he died, as the deponent was informed by a soldier of the army, as well as from a common report of his friends and connections, and adding the circimstances (sic) of his never having returned from the said army. James Hayes was not married and left an only brother named Jacob hayes who married and is now dead and leaving by marriage only two sons, William Hayes and Elisha Hayes, lieutenant, were issued 2560 acres. The grant was transferred by Calvin Jones to James Kimball.
