6 July 1814. Deed of Sale Robinson Haykes to William Thomson
  • [1] BEFORE the subscribing NOTARY PUBLIC residing in the Township of Shefford in the County of Richelieu in the District of Montréal in the Province of Lower Canada, personally appeared Robinson Haykes, of the Seignorie of St. Armand in the County of Bedford, in the sd District of Montréal, who, in the presence of the said Notary, and of the Witnesses hereinafter named, voluntarily declared and acknowledged that, for and in consideration of the sum of two hundred Dollars unto him in hand well and truly paid before the execution of these presents, by William Thomson of St. Armand aforesaid, Trader, (the receipt and payment whereof the said Robinson Haykes did and hereby acknowledge and thereof and every part thereof acquit, exonerate and discharge the said William Thomson, his Heirs and Assigns for ever) he the said Robinson Haykes hath bargained, granted and sold, and by these presents doth bargain, grant, sell, alien, enfeoff, convey and confirm, from henceforth for ever unto the Said William Thomson present hereto & accepting Sixteen Rods of Land in superficies part & parcel of that Tract of Land known & distinguished by Lot Number Eighty two, the Said Sixteen rods lying in a Square form is bounded to the North in part by the Highway leading to Missisquoi Bay to the West on one Side by the Easterly boundary line of the part of the Said Lot Number Eighty two which he the sd Robinson Haykes has purchased of Adam Sager, and to the East on the other Side & South in rear by the part of the aforesaid Lot which is owned & possessed by John Martin, as the Said piece of Land is with a Framed dwelling house thereon standing & all other improvements made thereon – and generally all and every the Estate and Estates, Rights, Titles, Interests, Property, Claims and Demands whatsoever, of him the said Robinson Haykes of, in, to or out of the said piece of Land and premises and every part and parcel thereof, as the Same was unto him conveyed by Reuben Ainsworth by Deed dated the 2nd day of March A.D. 1811, executed before Ls. Barbeau Notary Public
  • [2]TO HAVE AND TO HOLD the said piece of Land & Premises and every part and parcel thereof with its appurtenances unto the said William Thomson his Heirs and Assigns, to the payment of a proportionate Share of the annual & perpetual quit Rent wherewith the aforesaid Lot of Land is charged to the Deed of the Commission thereof, Quit however of the Same for the first day of May last past. And the said Robinson Haykes in the presence of us the said Notary and witnesses, for himself, his Heirs, Executors, Curators and Administrators, did and doth hereby grant and covenant to and with the said William Thomson his Heirs, and Assigns that he the said Robinson Haykes, and his Heirs, the said piece of Land and premise and every part and parcel thereof, with all and singular its rights, members and appurtenances, unto the said William Thomson his Heirs and Assigns, against him the said Robinson Haykes and his Heirs, and against all and every person and persons whomsoever, shall and will warrant and for ever defend by these presents. And further, that he the said Robinson Haykes and his or their heirs, any thing having or claiming in the same piece of Land and Premises or any part thereof, by, from or under him shall and will, from time to time and at all times hereafter, upon every reasonable request and at the cost and charges of the said William Thomson his heirs or assigns, well and truly make, do and execute, or cause to be made, done and executed, all and every such further and other lawful and reasonable act and acts, conveyance and conveyances, thing or things whatsoever necessary, for the further, better and more perfect granting, conveying and assuring of all and singular the said Piece of Land and Premises above mentioned, with its appurtenances, unto the said William Thomson, his Heirs and Assigns forever, as by the said William Thomson his Heirs or Assigns, or his or their council, learned in the law, shall be reasonably devised, advised or required; for which and every other purpose necessary in the premises, the said Robinson Haykes hath made election of his Domicil at St. Armand aforesaid, WHERE, &c. Notwithstanding, &c. Promising, &c. Obliging, &c. Renouncing, &c.
  • [3] THIS DONE AND PASSED at Said St. Armand – in the house of Jacob Cook in the forenoon of the Sixth day of July in the year of Our Lord, [1814] in the presence of Josiah Millard – and James Ingalls – the said Witnesses, and the Parties hereto have to these presents (first duly read according to law) set and subscribed their names in the presence of the said Notary and witnesses, who with them the said Parties, have also hereunto set and subscribed our names in faith and testimony of the premises.
